Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974,
as amended (“Act”), 19 U.S.C. § 2273, the Department of
Labor issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on February 6, 2014,
applicable to workers of International Paper Company,
Cortland Alabama Paper Mill, Printing & Communications
Paper Division, a subsidiary of International Paper
Company, including on-site leased workers from Manpower,
Western Express, Liberty Healthcare, and K2 Mansfield,
Cortland, Alabama (TA-W-83,129). The Department’s notice
of determination was published in the Federal Register on
February 24, 2014 (79 FR 10189).

Following the filing of a petition on behalf of
workers of International Paper Company, Customer Service
Center, Printing & Communication Paper Division, Suffolk,
Virginia (TA-W-85,745), the Department reviewed the
certification for workers of the subject firm. The
investigation revealed that workers from at the Customer
Service Center, Printing & Communication Paper Division,
Suffolk, Virginia, were in support of the production
facility in Cortland, Alabama.

The amended notice applicable to TA-W-83,129 is
hereby issued as follows:

"All workers of International Paper Company,
Cortland Alabama Paper Mill, Printing & Communications
Paper Division, a subsidiary of International Paper
Company, including on-site leased workers from Manpower,
Western Express, Liberty Healthcare, and K2 Mansfield,
Cortland, Alabama (TA-W-83,129) and International Paper
Company, Customer Service Center, Printing & Communication
Paper Division, a subsidiary of International Paper Company,
Suffolk, Virginia (TA-W-83,129A) who became totally or
partially separated from employment on or after October 10,
2012 through February 6, 2016, and all workers in the group
threatened with total or partial separation from employment
on February 6, 2014 through February 6, 2016, are eligible
to apply for adjustment assistance under Chapter 2 of Title
II of the Trade Act of 1974, as amended.”

In accordance with Section 223 of the Trade Act of 1974,
as amended (“Act”), 19 U.S.C. § 2273, the Department of
Labor issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on February 6, 2014, applicable
to workers International Paper Company, Alabama Paper Mill,
Printing & Communication Papers Division, a subsidiary of
International Paper Company, including on-site leased workers
from Manpower, Western Express, and Liberty Healthcare Corporation,
Courtland, Alabama. The Department’s Notice of Determination
was published in the Federal Register on February 24, 2014
(79 FR 3840).

In response to a petition (TA-W-85,452) filed on behalf of
workers at K2 Mansfield, Courtland, Alabama, the Department
reviewed the certification for workers of the subject firm.
The workers were engaged in the production of uncoated and
coated freesheet paper products. The investigation confirmed
that on-site leased workers from K2 Mansfield worked on-site
at the Courtland, Alabama location.

Based on these findings, the Department is amending
this certification to include on-site leased workers from
K2 Mansfield. The amended notice applicable to TA-W-83,129
is hereby issued as follows:

"All workers International Paper Company, Alabama
Paper Mill, Printing & Communication Papers Division, a
subsidiary of International Paper Company, including on-site
leased workers from Manpower, Western Express, Liberty
Healthcare Corporation, and K2 Mansfield, Courtland, Alabama,
who became totally or partially separated from employment
on or after October 10, 2012, through February 6, 2016, and
all workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are eligible
to apply for adjustment assistance under Chapter 2 of Title
II of the Trade Act of 1974, as amended.”

In accordance with Section 223 of the Trade Act of 1974,
as amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued an Amended Certification of Eligibility to Apply for
Worker Adjustment Assistance on March 13, 2014, applicable to
workers of International Paper Company, Courtland Alabama Paper
Mill, Printing & Communications Papers Division, a subsidiary
of International Paper Company, including on-site leased workers
from Manpower and Western Express, Courtland, Alabama.

The workers are engaged in activities related to the production
of coated and uncoated freesheet paper. At the request from a
Liberty Healthcare Corporation official, the Department reviewed
the certification for workers of the subject firm.

Additional information from International Paper Company confirms
that workers leased from Liberty Healthcare Corporation were
employed on-site at the Courtland, Alabama location of International
Paper Company, Courtland Alabama Paper Mill, Printing & Communications
Papers Division, a subsidiary of International Paper Company. The
Department has determined that these workers were sufficiently under
the control of International Paper Company to be considered leased
workers. The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by
increased imports of coated and uncoated freesheet paper.

Based on these findings, the Department is amending this
certification to include workers leased from Liberty Healthcare
Corporation working on-site at the Courtland, Alabama location
of the subject firm.

The amended notice applicable to TA-W-83,129 is hereby issued as follows:

"All workers from International Paper Company, Alabama Paper
Mill, Printing & Communication Papers Division, a subsidiary of
International Paper Company, including on-site leased workers from
Manpower, Western Express, and Liberty Healthcare Corporation,
Courtland, Alabama, who became totally or partially separated from
employment on or after October 10, 2012 through February 6, 2016,
and all workers in the group threatened with total or partial
separation from employment on date of certification through two
years from the date of certification, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the Trade
Act of 1974, as amended.”

At the request from the State of Tennessee, the Department
reviewed the certification for workers of the subject firm. New
information from the company shows that workers leased from
Western Express were employed on-site at the Courtland, Alabama
location of International Paper Company, Courtland Alabama Paper
Mill, Printing & Communications Papers Division, a subsidiary of
International Paper Company. The Department has determined that
these workers were sufficiently under the control of
International Paper Company, Courtland Alabama Paper Mill,
Printing & Communications Papers Division, a subsidiary of
International Paper Company to be considered leased workers.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by
increased imports of coated and uncoated freesheet paper.
Based on these findings, the Department is amending this
certification to include workers leased from Western Express
working on-site at the Courtland, Alabama location of the
subject firm.


The amended notice applicable to TA-W-83,129 is hereby
issued as follows:

"All workers from International Paper Company, Alabama
Paper Mill, Printing & Communication Papers Division,
a subsidiary of International Paper Company, including
on-site leased workers from Manpower and Western
Express, Courtland, Alabama, who became totally or
partially separated from employment on or after
October 10, 2012 through February 6, 2016, and all
workers in the group threatened with total or partial

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
(Department) herein presents the results of an investigation
regarding certification of eligibility to apply for worker
adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in
such workers’ firm have become totally or partially separated,
or are threatened to become totally or partially separated; and
(2)(A)(i) the sales or production, or both, of such firm
have decreased absolutely; and
(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by such
firm have increased; and
(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or threat of
separation and to the decline in the sales or production of such
firm.
“Like or directly competitive” means that “like” articles
are those which are substantially similar in inherent or
intrinsic characteristics and that “directly competitive”
articles are those which are substantially equivalent for
commercial purposes (adapted to the same uses and, therefore,
exchangeable). 29 CFR 90.2
“Significant number or proportion of the workers” means, in
most cases, that in a workforce of fifty or more workers in a firm
(or appropriate subdivision), the total or partial separations (or
both) are the equivalent to a total unemployment of five percent
(5%) of the workers or 50 workers, whichever is less. 29 CFR 90.2
A factor which “contributed importantly” means, for purposes
of the Act, a cause which is important but not necessarily more
important than any other cause. 29 CFR 90.16(b)(3)
The investigation was initiated in response to a Trade
Adjustment Assistance (TAA) petition filed on October 17, 2013 by
representatives of the United Steel, Paper and Forestry, Rubber,
Manufacturing, Energy, Allied Industrial and Services Workers
International Union (USW), Locals 1137, 1161, and 193, on behalf of
workers of International Paper Company, Courtland Alabama Paper
Mill, Printing & Communication Papers Division, a subsidiary of
International Paper Company, Courtland, Alabama (International
Paper-Courtland). Workers at International Paper-Courtland are
engaged in activities related to the production of coated and
uncoated freesheet paper, and are not separately identifiable by
article produced. The subject worker group includes on-site leased
workers of Manpower.
The petition alleged “imports have increased relative to
demand” and included as support documentation an undated letter
from International Paper (stating “we are seeing European producers
increase imports to North America”), an undated USW memorandum
(titled “Import Trends in Uncoated Paper”), a letter to the
Department dated October 10, 2013, and references to an on-line
blog and a U.S. International Trade Commission finding.
During the course of the investigation, the Department
collected information from the workers’ firm, reviewed material
submitted by the petitioners, conducted a customer survey of
International Paper-Courtland’s major declining customers, and
conducted an industry analysis of uncoated freesheet paper which
included the impact of aggregate imports of uncoated freesheet
paper on the domestic paper industry.
Section 222(a)(1) has been met because a significant number or
proportion of the workers at International Paper-Courtland has
become totally or partially separated, or is threatened with total
or partial separation.
Section 222(a)(2)(A)(i) has been met because sales and
production at International Paper-Courtland have decreased
absolutely.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with the freesheet paper
produced at International Paper-Courtland have increased during the
relevant period.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased imports contributed importantly to the worker group
separations and sale/production declines at International Paper-
Courtland.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of International Paper
Company, Courtland Alabama Paper Mill, Printing & Communication
Papers Division, a subsidiary of International Paper Company,
Courtland, Alabama, meet the worker group certification criteria
under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance
with Section 223 of the Act, 19 U.S.C. § 2273, I make the following
certification:
“All workers of International Paper Company, Courtland Alabama
Paper Mill, Printing & Communication Papers Division, a
subsidiary of International Paper Company, including on-site
leased workers of Manpower, Courtland, Alabama, who became
totally or partially separated from employment on or after
October 10, 2012 through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
