Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of
1974, as amended (“Act”), 19 U.S.C. § 2273, the Department
of Labor issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on July 25, 2013, applicable to
workers from Bausch & Lomb Incorporated, North Goodman Street
Facility, a subsidiary of Valeant Pharmaceuticals International,
Inc., including on-site leased workers from Kelly Services and
Aerotek, Rochester, New York (TA-W-82,963) and Bausch & Lomb
Incorporated, Bausch & Lomb Place Facility, a subsidiary of
Valeant Pharmaceuticals International, Inc., including on-site
leased workers from Kelly Services, Rochester, New York
(TA-W-82,963A). The Department’s Notice of Determination
was published in the Federal Register on December 23, 2013
(78 FR 77498).

At the request of a State Workforce Official, the
Department reviewed the certification for workers of the
subject firm. The workers’ firm is engaged in the production
of contact lenses.

The investigation confirmed that workers from Computech
Corp. were employed on site at the Bausch & Lomb Incorporated
facilities. The workers were suffiently under the operational
control of Bausch & Lomb Incorporated to be considered leased
workers.

Based on these findings, the Department is amending this
certification to include the on-site leased workers from
Computech Corp.

The amended notice applicable to TA-W-82,963 is hereby issued
as follows:

“All workers of Bausch & Lomb Incorporated, North Goodman
Street Facility, a subsidiary of Valeant Pharmaceuticals International,
Inc., including on-site leased workers from Kelly Services Aerotek and
Computech Corp., Rochester, New York (TA-W-82,963) and Bausch & Lomb
Incorporated, Bausch & Lomb Place Facility, a subsidiary of Valeant
Pharmaceuticals International, Inc., including on-site leased workers
from Kelly Services and Computech Corp., Rochester, New York
(TA-W-82,963A), who became totally or partially separated from
employment on or after August 7, 2012 through December 2, 2015, and
all workers in the group threatened with total or partial separation
from employment on the date of certification through December 2, 2015,
are eligible to apply for adjustment assistance under Chapter 2 of
Title II of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on August 8, 2013 by a state workforce office on behalf
of workers of Bausch & Lomb Incorporated, North Goodman Street
Facility, a subsidiary of Valeant Pharmaceuticals
International, Inc., including on-site leased workers from
Kelly Services and Aerotek, Rochester, New York (TA-W-82,963)
and Bausch & Lomb Incorporated, Bausch & Lomb Place Facility,
a subsidiary of Valeant Pharmaceuticals International, Inc.,
including on-site leased workers from Kelly Services,
Rochester, New York (TA-W-82,963A). The worker group, Bausch &
Lomb Incorporated, North Goodman Street Facility, a subsidiary
of Valeant Pharmaceuticals International, Inc., including on-
site leased workers from Kelly Services and Aerotek,
Rochester, New York (TA-W-82,963), is engaged in activities
related to the production of contact lenses. The worker group,
Bausch & Lomb Incorporated, Bausch & Lomb Place Facility, a
subsidiary of Valeant Pharmaceuticals International, Inc.,
including on-site leased workers from Kelly Services,
Rochester, New York (TA-W-82,963A), is engaged in activities
related to the supply of corporate functions which support the
North Goodman Street facility (TA-W-82,963). The corporate
functions include: financial planning and analysis, tax
services, treasury service, business development,
communications, corporate human resources, legal, and
compliance.
During the course of the investigation, information was
collected from the workers' firm and the firm's customers.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales or
production of contact lenses by Bausch & Lomb have decreased.
Section 222(a)(2)(A)(ii) has been met because customer
imports of articles like or directly competitive with the
article produced by Bausch & Lomb have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased customer imports contributed importantly to the
worker group separations and sales declines at Bausch & Lomb.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Bausch & Lomb
Incorporated, North Goodman Street Facility, a subsidiary of
Valeant Pharmaceuticals International, Inc., including on-site
leased workers from Kelly Services and Aerotek, Rochester, New
York (TA-W-82,963) and Bausch & Lomb Incorporated, Bausch &
Lomb Place Facility, a subsidiary of Valeant Pharmaceuticals
International, Inc., including on-site leased workers from
Kelly Services, Rochester, New York (TA-W-82,963A), who are
engaged in activities related to the production of contact
lenses and corporate office functions meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:


"All workers of Bausch & Lomb Incorporated, North Goodman
Street Facility, a subsidiary of Valeant Pharmaceuticals
International, Inc., including on-site leased workers
from Kelly Services and Aerotek, Rochester, New York (TA-
W-82,963) and Bausch & Lomb Incorporated, Bausch & Lomb
Place Facility, a subsidiary of Valeant Pharmaceuticals
International, Inc., including on-site leased workers
from Kelly Services, Rochester, New York (TA-W-82,963A),
who became totally or partially separated from employment
on or after August 7, 2012 through two years from the date
of certification, and all workers in the group threatened
with total or partial separation from employment on the
date of certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
