Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on June 7, 2013, applicable to workers of
Sanyo Solar of Oregon, LLC, Wafer Slicing and Quality Control
Operations, Salem, Oregon, including on-site leased workers from
Brown and Dunton, Inc., Salem, Oregon. The Department’s notice
of determination was published in the Federal Register on July
2, 2013 (Volume 78 FR page 39778).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers were engaged in the production of polysilicon wafers and
included workers who supplied quality control and support
functions.
The company reports that workers leased from Cirk
Solutions, Inc. were employed on-site at the Salem, Oregon
location of Sanyo Solar of Oregon, LLC, Wafer Slicing and
Quality Control Operations. The Department has determined that
these workers were sufficiently under the control of the subject
firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Cirk Solutions,
Inc. working on-site at the Salem, Oregon location of Sanyo
Solar of Oregon, LLC, Wafer Slicing and Quality Control
Operations.
The amended notice applicable to TA-W-82,703 is hereby
issued as follows:
"All workers of Cirk Solutions, Inc., reporting to
Sanyo Solar of Oregon, LLC, Wafer Slicing and Quality
Control Operations, Salem, Oregon, including on-site
leased workers from Brown and Dunton, Inc., Salem,
Oregon, who became totally or partially separated from
employment on or after May 1, 2012, through June 7,
2015, and all workers in the group threatened with
total or partial separation from employment on the
date of certification through two years from the date
of certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade
Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on May 2, 2013 by a company official on behalf of workers of
Sanyo Solar of Oregon, LLC, Wafer Slicing and Quality Control
Operations, Salem, Oregon. The workers’ firm is a manufacturer of
polysilicon wafers. The subject worker group is engaged in
activities related to the production of polysilicon wafers and is
inclusive of workers who supply quality control and support
functions. The worker group is comprised of on-site leased workers
from Brown and Dunton, Inc. Workers at this facility are separately
identifiable by product.
During the course of the investigation, information was
collected from the workers’ firm.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in such workers’ firm have become
totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(a)(2)(B) has been met because the workers’ firm
is acquiring from a foreign country articles like or directly
competitive with the polysilicon wafers produced by the workers,
which is contributing importantly to worker group separations at
Sanyo Solar of Oregon, LLC.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Sanyo Solar of Oregon,
LLC, Wafer Slicing and Quality Control Operations, including on-
site workers from Brown and Dunton, Inc., Salem, Oregon, who are
engaged in activities related to the production of polysilicon
wafers meet the worker group certification criteria under Section
222(a) of the Act, 19 U.S.C. § 2272(a). In accordance with
Section 223 of the Act, 19 U.S.C. § 2273, I make the following
certification:
“All workers of Sanyo Solar of Oregon, LLC, Wafer Slicing
and Quality Control Operations, including on-site workers
from Brown and Dunton, Inc., Salem, Oregon, who became
totally or partially separated from employment on or after
May 1, 2012, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
