Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974,
as amended (“Act”), 19 U.S.C. § 2273, the Department
of Labor issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on May 8, 2013, applicable
to workers of LexisNexis/Matthew Bender, a Reed Elsevier,
Inc. Subsidiary, not including the Customer Service and
Fulfillment Departments Albany, New York. The Department’s
notice of determination was published in the Federal
Register on May 30, 2013 (78 FR 32464). At the request
of State Workforce Office, the Department reviewed the
certification for workers of the subject firm. The
workers are engaged in activities related to the supply
of online legal research tools and solutions services.

The investigation revealed that worker separations in
the Customer Service and Fulfillment Departments in
Albany, New York are attributable to an acquisition
of services from a foreign country. Workers in those
departments had been covered under a previous
certification (TA-W-81,638A) that expired on June 1, 2014.

The amended notice applicable to TA-W-82,571 is hereby
issued as follows:

"All workers of LexisNexis/Matthew Bender, A Reed Elsevier,
Inc. Subsidiary, not including the Customer Service and
Fulfillment Departments, Albany, New York (TA-W-82,571)
and LexisNexis, Customer Support and Fulfillment
Departments, Miamisburg, Ohio (TA-W-82,571A) who became
totally or partially separated from employment on or
after March 18, 2013 through May 8, 2015, and all
workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under
Chapter 2 of Title II of the Trade Act of 1974, as amended,

AND

All workers of LexisNexis, Customer Support and Fulfillment
Departments, Miamisburg, Ohio (TA-W-82,571A) and LexisNexis/
Matthew Bender, a Reed Elsevier, Inc. Subsidiary, Customer
Support and Fulfillment Department, Albany, New York
(TA-W-82,571B), who became totally or partially separated
from employment on or after June 2, 2014 through May 8,
2015, and all workers in the group threatened with total
or partial separation from employment on the date of
certification through two years from the date of certification,
are eligible to apply for adjustment assistance under Chapter
2 of Title II of the Trade Act of 1974, as amended.”

The subject firm confirmed that LexisNexis, Customer Support
and Fulfillment Departments, Miamisburg, Ohio (TA-W-82,571A)
is part of the subject worker group; the subject workers are
engaged in activities related to the supply of research tools
and solutions services; and the subject workers are affected
by the acquisition of services from a foreign country.
Workers covered by TA-W-82,571A are eligible to apply for
Trade Adjustment Assistance under TA-W-81,638 (certification
expires on June 1, 2014). The amended notice applicable to
TA-W-82,571 is hereby issued as follows:

"All workers of LexisNexis/Matthew Bender, a Reed Elsevier,
Inc. Subsidiary, not including the Customer Service and
Fulfillment Departments, Albany, New York (TA-W-82,571)
who became totally or partially separated from employment
on or after March 18, 2012, and all workers in the group
threatened with total or partial separation from employment
on date of certification through May 8, 2015, are eligible
to apply for adjustment assistance under Chapter 2 of Title
II of the Trade Act of 1974, as amended; and all workers
of LexisNexis, Customer Support and Fulfillment, Miamisburg,
Ohio (TA-W-82,571A) who became totally or partially separated
from employment on or after June 2, 2014, and all workers in
the group threatened with total or partial separation from
employment on date of certification through May 8, 2015,
are eligible to apply for adjustment assistance under

Amended Certification Regarding Eligibility

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on May 8, 2013, applicable to workers
of LexisNexis/Matthew Bender, a Reed Elsevier, Inc. Subsidiary,
not including the Customer Service and Fulfillment Departments,
Albany, New York (“Lexis/Nexis”). The Department’s notice of
determination was published in the Federal Register on May 30,
2013 (78 FR 32466). The Customer Service and Fulfillment
Departments of Lexis/Nexis are certified under TA-W-81,638A
that expires on June 1, 2014. At the request of workers, the
Department reviewed the certification for workers of the subject
firm. The workers are engaged in activities related to the supply
of online legal research tools and solutions services.

A review of the certification under TA-W-82,571 revealed that
the affirmative determination contained a technical error.
The determination noted that the workers were “engaged in
activities related to the supply of online legal research
tools and solutions services, specifically finance activities
(accounts receivable, general accounting, royalties, and
credit collections) that support the firm’s supply of online
legal research tools and solutions services.” The
determination should read, “engaged in activities related
to the supply of online legal research tools and solutions
services.” The determination should not have suggested that
the certified worker group was limited beyond the specific
exclusion of the Customer Service and Fulfillment Departments,
which were already certified under TA-W-81,638A.

The intent of the Department is to include all workers impacted
by the acquisition of services like or directly competitive from
a foreign country. The amended notice applicable to TA-W-82,571
is hereby issued as follows:


"All workers of LexisNexis/Matthew Bender, a Reed Elsevier, Inc.
Subsidiary, not including the Customer Service and Fulfillment
Departments, Albany, New York engaged in activities related to
the supply of online legal research tools and solutions services
who became totally or partially separated from employment on or
after March 8, 2012 through May 8, 2015, and all workers in the
group threatened with total or partial separation from employment
on the date of certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the
workers in such workers' firm have become totally or
partially separated, or are threatened to become
totally or partially separated;
(2)(B)(i)(I) there has been a shift by the workers'
firm to a foreign country in the production of
articles or supply of services like or directly
competitive with those produced/supplied by the
workers' firm; OR
(II) there has been an acquisition from a
foreign country by the workers' firm of
articles/services that are like or directly
competitive with those produced/supplied by
the workers' firm; AND
(ii) the shift/acquisition must have contributed
importantly to the workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on March 19, 2013 by a company official on behalf of
workers of LexisNexis/Matthew Bender, a Reed Elsevier, Inc.
Subsidiary, Albany, New York (LexisNexis). The workers' firm
is engaged in activities related to the supply of online legal
research tools and solutions services.
Workers of LexisNexis/Matthew Bender, a Reed Elsevier,
Inc. Subsidiary, Albany, New York in the Customer Service
Department and Fulfillment Department are currently certified
under petition number TA-W-81,638 that expires on June 1, 2014.
Therefore, those workers are excluded from this certification.
During the course of the investigation, information was
collected from the workers' firm.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(B) has been met because the workers'
firm has acquired from a foreign country services like or
directly competitive with services supplied by the workers which
contributed importantly to worker group separations at
LexisNexis.

Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of LexisNexis/Matthew
Bender, a Reed Elsevier, Inc. Subsidiary, not including the
Customer Service and Fulfillment Departments, Albany, New York
who are engaged in activities related to the supply of online
legal research tools and solutions service, specifically
finance activities (accounts receivable, general accounting,
royalties, and credit collections) that support the firm's
supply of online legal research tools and solutions service,
meet the worker group certification criteria under Section
222(a) of the Act, 19 U.S.C. § 2272(a). In accordance with
Section 223 of the Act, 19 U.S.C. § 2273, I make the following
certification:


"All workers of LexisNexis/Matthew Bender, a Reed
Elsevier, Inc. Subsidiary, not including the Customer
Service and Fulfillment Departments, Albany, New York, who
became totally or partially separated from employment on or
after March 18, 2012 through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended."
