Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued a Certification of Eligibility to Apply for Worker Adjustment Assistance on February 19, 2013, applicable to workers of Interstate Brands Corporation (IBC), a wholly owned subsidiary of Hostess Brands, Inc., including on-site leased workers from Stivers Temporary Personnel, operating throughout the state of Illinois. The Department’s notice of determination was published in the Federal Register on February 25, 2014 (78 FR 12795).
At the request of a state workforce office, the Department reviewed the certification for workers of the subject firm. The workers were engaged in activities related to the production of baked goods.
The company reports that workers leased from Real Time Staffing Services, Inc. (doing business as Select Staffing aka Koosharem, LLC) and Remx were employed on-site at the Schiller Park, Illinois location of Interstate Brands Corporation (IBC), a wholly owned subsidiary of Hostess Brands, Inc. The Department has determined that these workers were sufficiently under the control of the subject firm to be considered leased workers.
Based on these findings, the Department is amending this certification to include workers leased from Real Time Staffing Services, Inc. (doing business as Select Staffing aka Koosharem, LLC) and Remx working on-site at the Schiller Park, Illinois location of Interstate Brands Corporation (IBC), a wholly owned subsidiary of Hostess Brands, Inc.
The amended notice applicable to TA-W-82,165L is hereby issued as follows:

"All workers of Interstate Brands Corporation (IBC), a wholly owned subsidiary of Hostess Brands, Inc., including on-site leased workers from Stivers Temporary Personnel, Real Time Staffing Services, Inc. (doing business as Select Staffing aka Koosharem, LLC) and Remx, operating throughout the state of Illinois, who became totally or partially separated from employment on or after November 19, 2011 through February 19, 2015, and all workers in the group threatened with total or partial separation from employment on the date of certification through two years from the date of certification, are eligible to apply for adjustment assistance under Chapter 2 of Title II of the Trade Act of 1974, as amended.”

workers were engaged in activities related to the production of
baked goods such as bread, buns, rolls, snack cakes,
doughnuts, sweet rolls and similar products.
The company reports that workers leased from CorTech, LLC
were employed on-site at the West Helena, Arkansas location of
Interstate Brands Corporation (IBC), a wholly owned subsidiary
of Hostess Brands, Inc.. The Department has determined that
these workers were sufficiently under the control of the subject
firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from CorTech, LLC
working on-site at the West Helena, Arkansas location of
Interstate Brands Corporation (IBC), a wholly owned subsidiary
of Hostess Brands, Inc..

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

Section 222(c)(1) of the Act defines the term “contributed
importantly” to mean, “a cause which is important but not
necessarily more important than any other cause.”
The program regulations at 29 CFR Part 90.2 define “like or
directly competitive” to mean, “like articles are those which are
substantially identical in inherent or intrinsic characteristics
(i.e., materials from which the articles are made, appearance,
quality, texture, etc.); and directly competitive articles are
those which, although not substantially identical in their
inherent or intrinsic characteristics, are substantially
equivalent for commercial purposes (i.e., adapted to the same uses
and essentially interchangeable therefor)”.
The investigation was initiated in response to a petition
filed on November 20, 2012 by a state workforce office on behalf
of workers of Interstate Brands Corporation (IBC), a wholly owned
subsidiary of Hostess Brands, Inc., operating at locations
throughout the state of Michigan (TA-W-82,165). The petition was
expanded to include workers of Interstate Brands Corporation
(IBC), a wholly owned subsidiary of Hostess Brands, Inc.,
operating at locations throughout the state of Alabama (TA-W-
82,165A), Interstate Brands Corporation (IBC), a wholly owned
subsidiary of Hostess Brands, Inc., operating at locations
throughout the state of Alaska (TA-W-82,165B), Interstate Brands
Corporation (IBC), a wholly owned subsidiary of Hostess Brands,
Inc., operating at locations throughout the state of Arizona (TA-
W-82,165C), Interstate Brands Corporation (IBC), a wholly owned

The workers’ firm was engaged in activities related to the
production, distribution and sale of baked goods such as bread,
buns, rolls, snack cakes, doughnuts, sweet rolls and similar
products.

Great Plains Technical Services, Ridgeways, LLC (ARC), Synergy
Staffing Services, LLC, KForce Professional Staffing, and
Accenture, LLP (including subcontractors). TA-W-82,165X includes
on-site leased workers from Bookkeeping by Design. TA-W-82,165II
includes on-site leased workers from Randstad Professional US LP
(Accounts International). TA-W-82,165MM includes on-site leased
workers from Stinson Industrial Maintenance. TA-W-82,165NN
includes on-site leased workers from The Insource Group, and
Accenture, LLP.
The workers of Hostess Brands, Inc., field accounting
organization, in St. Louis, Missouri (TA-W-81,029), Hodgkins,
Illinois (TA-W-81,029A), Peoria, Illinois(TA-W-81,029B),
Davenport, Iowa (TA-W-81,029C), Alexandria, Louisiana (TA-W-
81,029D), Cincinnati, Ohio (TA-W-81,029E), Biddieford, Maine (TA-
W-81,029F), Ogden, Utah (TA-W-81,029G), Tulsa, Oklahoma (TA-W-
81,029H), Emporia, Kansas (TA-W-81,029I), Indianapolis, Indiana
(TA-W-81,029J), Philadelphia, Pennsylvania (TA-W-81,029K),
Northwood, Ohio (TA-W-81,029L), Rocky Mount, North Carolina (TA-
W-81,029M), Knoxville, Tennessee (TA-W-81,029N), Memphis,

on January 24, 2014; and therefore, are not covered by this
certification.
During the course of the investigation, information was
collected from the workers’ firm and its major declining
customers.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in such workers’ firm have become
totally or partially separated, or are threatened to become totally
or partially separated.
Section 222(a)(2)(A)(i) has been met because the sales and
production of baked goods by IBC have decreased absolutely.
Section 222(a)(2)(A)(ii) has been met because customer
imports of articles like or directly competitive with the baked
goods produced by IBC have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased customer imports contributed importantly to the worker
group separations and sales and production declines at IBC.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Interstate Brands
Corporation (IBC), a wholly owned subsidiary of Hostess Brands,
Inc., operating at locations throughout the state of Michigan
