Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on October 2, 2012, applicable to workers of RG Steel
Wheeling, LLC, Wheeling Office, a division of RG Steel, LLC,
including on-site leased workers from Pro Unlimited and Green
Energy Initiatives, LLC, Wheeling, West Virginia (TA-W-81,880)
and Mountain State Carbon, LLC, including workers whose wages
were reported through RG Steel Wheeling, LLC, Follansbee, West
Virginia (TA-W-81,880A). The Department’s notice of determination
was published in the Federal Register on October 19, 2012 (77 FR
64357).
At the request of a state workforce office, the Department
reviewed the certification for workers of the subject firm. The
workers are engaged in activities related to the production of
coke.
New information shows that some workers separated from
employment at the Wheeling Office (TA-W-81,880) and Mountain
State Carbon (TA-W-81,880A) had their wages reported through a
separate unemployment insurance (UI) tax account under the name
Severstal Wheeling, a former owner of the workers’ firms.
The intent of the Department’s certification is to include
all workers of the subject firm who meet the worker group
certification criteria under Section 222(a) of the Act, 19 U.S.C.
§ 2272(a).
Accordingly, the Department is amending this certification
to properly reflect this matter. The amended notice applicable
to TA-W-81,880 and TA-W-81,880A is hereby issued as follows:







"All workers of RG Steel Wheeling, LLC, Wheeling Office, a
division of RG Steel, LLC, including on-site leased workers
from Pro Unlimited and Green Energy Initiatives, LLC,
Wheeling, West Virginia (TA-W-81,880) and Mountain State
Carbon, LLC, including workers whose wages were reported
through RG Steel Wheeling, LLC, Follansbee, West Virginia
(TA-W-81,880A), including workers, at both firms, whose
unemployment insurance (UI) wages are reported through
Severstal Wheeling who became totally or partially separated
from who became totally or partially separated from
employment on or after August 7, 2011 through October 2,
2014, and all workers in the group threatened with total or
partial separation from employment on date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on August 9, 2012 by the United Steelworkers (USW), Local
1190 on behalf of workers of RG Steel Wheeling, LLC, Wheeling
Office, a division of RG Steel, LLC, Wheeling, West Virginia,
herein known as “RG Steel Wheeling Office” and Mountain State
Carbon, LLC, Follansbee, West Virginia herein known as “Mountain
State Carbon”. Mountain State Carbon was a fifty/fifty joint
venture with RG Steel and Severstal North America (SNA).
The workers’ firm is engaged in activities related to the
production of steel. The subject worker group for RG Steel
Wheeling Office (TA-W-81,880) supplied administrative office
services to RG Steel Wheeling operating sites. The subject worker
group for Mountain State Carbon (TA-W-81,880) produced coke used in
the blast furnace in the production of steel. Both worker groups
are a part of RG Steel’s vertical integrated steel-making process,
supplying administrative services and coke product to several RG
Steel firms whose workers were certified eligible to apply for
Trade Adjustment Assistance (TAA).
The RG Steel Wheeling Office (TA-W-81,880) worker group
included on-site leased workers from PRO Unlimited and Green Energy
Initiatives LLC. The Mountain State Carbon (TA-W-81,880A) worker
group includes workers whose wages were reported through RG Steel
Wheeling, LLC.
During the course of the investigation, information was
collected from the workers’ firm.
Section 222(a)(1) has been met because a significant number or
proportion of the workers in such workers’ firm have become totally
or partially separated, or are threatened to become totally or
partially separated.
Section 222(a)(2)(A)(i) has been met because the supply of
administrative office services by RG Steel Wheeling Office and
production of coke by Mountain State Carbon have decreased
absolutely.
Section 222(a)(2)(A)(ii) has been met because customer imports
of steel coils like or directly competitive with the article
produced by the firm have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased customer imports contributed importantly to the worker
group separations and sales/production declines at RG Steel
Wheeling Office and Mountain State Carbon.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of RG Steel Wheeling, LLC,
Wheeling Office, a division of RG Steel, LLC, Wheeling, West
Virginia including on-site leased workers from PRO Unlimited and
Green Energy Initiatives LLC, who are engaged in activities related
to the supply of administrative office services (TA-W-81,880) and
Mountain State Carbon, LLC, including workers whose wages were
reported through RG Steel Wheeling, LLC, Follansbee, West Virginia,
who are engaged in activities related to the production of coke
(TA-
W-81,880A) meet the worker group certification criteria under
Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance with
Section 223 of the Act, 19 U.S.C. § 2273, I make the following
certification:
“All workers of RG Steel Wheeling, LLC, Wheeling Office, a
division of RG Steel, LLC, Wheeling, West Virginia including
on-site leased workers from PRO Unlimited and Green Energy
Initiatives LLC (TA-W-81,880) and Mountain State Carbon, LLC,
including workers whose wages were reported through RG Steel
Wheeling, LLC, Follansbee, West Virginia (TA-W-81,880A), who
became totally or partially separated from employment on or
after August 7, 2011 through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of


certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
