Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on July 20, 2012, applicable to workers of WellPoint,
Inc., Senior Business Division, Claims Department, including
workers whose unemployment insurance (UI) wages reported through
The WellPoint Companies, Inc., Indianapolis, Indiana, including
off-site workers from Indiana reporting to Indianapolis, Indiana
(TA-W-81,772) and WellPoint, Inc., Senior Business Division,
Claims and Enrollment Departments, including on-site leased
workers from Aerotek, AppleOne Employment Services/The Act 1
Group, and Kelly Services, including workers whose unemployment
insurance (UI) wages were reported through The WellPoint
Companies of California, Inc., Newbury Park, California,
including off-site workers from California reporting to Newbury
Park, California (TA-W-81,772A). The Department’s notice of
determination was published in the Federal Register on August 2,
2012 (77 FR 46123).
At the request of a company official, the Department
reviewed the certification for workers of WellPoint, Inc. (the
subject firm). The workers are engaged in the supply of health
insurance and related specialty services.
The subject firm reports that workers at Wellpoint, Inc.,
Medicare Supplement Claims Unit, Wallingford, Connecticut supply
services like or directly competitive with those supplied by
workers at WellPoint, Inc., Senior Business Division, Claims
Department, Indianapolis, Indiana and WellPoint, Inc., Senior
Business Division, Claims and Enrollment Departments, Newbury
Park, California; Wellpoint, Inc., Medicare Supplement Claims
Unit, Wallingford, Connecticut operates in conjunctions with
WellPoint, Inc., Senior Business Division, Claims Department,
Indianapolis, Indiana and WellPoint, Inc., Senior Business
Division, Claims and Enrollment Departments, Newbury Park,
California; and workers of Wellpoint, Inc., Medicare Supplement
Claims Unit, Wallingford, Connecticut were impacted by the
subject firm’s shift in the supply of services overseas.
The worker group at Wellpoint, Inc., Medicare Supplement
Claims Unit, Wallingford, Connecticut includes on-site leased
workers from TEK Systems, Inc., Kelly Services, Inc., Indecon,
LLC, Pinnacle, CEI, ICONMA, Tyton, Aerotek, Aquent, Medpro,
Populus, MBO Partners, Robert Half International, Strategic
Staffing Solutions, Kelly OCG, SmartIT Staffing, Inc., and The
Act 1 Group, Inc, and includes workers whose unemployment
insurance wages were reported under The Wellpoint Companies,
Inc., Wallingford, Connecticut.
The amended notice applicable to TA-W-81,772 is hereby
issued as follows:
"All workers of WellPoint, Inc., Senior Business
Division, Claims Department, including workers whose
unemployment insurance (UI) wages reported through The
WellPoint Companies, Inc., Indianapolis, Indiana,
including off-site workers from Indiana reporting to
Indianapolis, Indiana (TA-W-81,772), WellPoint, Inc.,
Senior Business Division, Claims and Enrollment
Departments, including on-site leased workers from
Aerotek, AppleOne Employment Services/The Act 1 Group,
and Kelly Services, including workers whose
unemployment insurance (UI) wages were reported through
The WellPoint Companies of California, Inc., Newbury
Park, California, including off-site workers from
California reporting to Newbury Park, California (TA-W-
81,772A), and Wellpoint, Inc., Medicare Supplement
Claims Unit, including on-site leased workers from TEK
Systems, Inc., Kelly Services, Inc., Indecon, LLC,
Pinnacle, CEI, ICONMA, Tyton, Aerotek, Aquent, Medpro,
Populus, MBO Partners, Robert Half International,

eligible to apply for adjustment assistance under
Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers
in such workers' firm have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2)(B)(i)(I) there has been a shift by the workers’
firm to a foreign country in the production of articles
or supply of services like or directly competitive with
those produced/supplied by the workers’ firm; OR
(II) there has been an acquisition from a
foreign country by the workers’ firm of
articles/services that are like or directly
competitive with those produced/supplied by
the workers’ firm; AND
(ii) the shift/acquisition must have contributed
importantly to the workers’ separation or
threat of separation.

The investigation was initiated in response to a petition
filed on July 3, 2012 by a company official on behalf of workers
of WellPoint, Inc., Senior Business Division, Claims Department,
including workers whose unemployment insurance (UI) wages are
reported through The WellPoint Companies, Inc., Indianapolis,
Indiana, including off-site workers from Indiana reporting to
Indianapolis, Indiana (TA-W-81,772) and WellPoint, Inc., Senior
Business Division, Claims and Enrollment Department, including
workers whose unemployment insurance (UI) wages were reported
through The WellPoint Companies of California, Inc., Newbury
Park, California including off-site workers from California
reporting to Newbury Park, California (TA-W-81,772A)
(“WellPoint”). The workers’ firm is engaged in activities related
to the supply of health insurance and related specialty services.
Specifically, the workers of both groups process claims for the
Senior Business Division of WellPoint. TA-W-81,772A is the only
subject firm that has workers who also enroll people to the
firm’s health insurance membership services under the Senior
Business Division. The workers are separately identifiable by
the activities performed for the firm.
TA-W-81772A includes on-site leased workers from Aerotek,
AppleOne Employment Services/The Act 1 Group, and Kelly Services.
During the course of the investigation, information was
collected from the workers’ firm.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in such workers’ firm have become
totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(a)(2)(B) has been met because the workers’ firm
has shifted to a foreign country the supply of services like or
directly competitive with the services supplied by the workers
which contributed importantly to worker group separations at
WellPoint.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of WellPoint, Inc.,
Senior Business Division, Claims Department, including workers
whose unemployment insurance (UI) wages reported through The
WellPoint Companies, Inc., Indianapolis, Indiana, including off-
site workers from Indiana reporting to Indianapolis, Indiana (TA-
W-81,772) and WellPoint, Inc., Senior Business Division, Claims
and Enrollment Department, including on-site leased workers from
Aerotek, AppleOne Employment Services/The Act 1 Group, and Kelly
Services, including workers whose unemployment insurance (UI)
wages were reported through The WellPoint Companies of
California, Inc., Newbury Park, California, including off-site
workers from California reporting to Newbury Park, California
(TA-W-81,772A), who are engaged in activities related to the
supply of health insurance and related specialty services (claims
and enrollment) meet the worker group certification criteria
under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:
“All workers of WellPoint, Inc., Senior Business Division,
Claims Department, including workers whose unemployment
insurance (UI) wages were reported through The WellPoint
Companies, Inc., Indianapolis, Indiana, including off-site
workers from Indiana reporting to Indianapolis, Indiana (TA-
W-81,772) and WellPoint, Inc., Senior Business Division,
Claims and Enrollment Department, including on-site leased
workers from Aerotek, AppleOne Employment Services/The Act 1
Group, and Kelly Services, including workers whose
unemployment insurance (UI) wages were reported through The
WellPoint Companies of California, Inc., Newbury Park,
California, including off-site workers from California
reporting to Newbury Park, California (TA-W-81,772A), who
became totally or partially separated from employment on or
after July 2, 2011 through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
