Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on July 25, 2012, applicable to workers and former
workers of Cinram Manufacturing, LLC, a subsidiary of Cinram
International, Olyphant, Pennsylvania (TA-W-81,726), Cinram
Distribution, LLC, a subsidiary of Cinram International,
LaVergne, Tennessee (TA-W-81,726A), and two leased worker groups
(TA-W-81,726B and TA-W-81,726C). The subject worker groups are
engaged in activities related to the production, packaging, and
distribution of optical media devices.
At the request of the State of Pennsylvania, the Department
reviewed the certification. New information revealed that the
subject firm is currently doing business as Cinram Group Inc.
The amended notice applicable to TA-W-81,726 is hereby
issued as follows:
“All workers of Cinram Manufacturing, LLC, (currently doing
business as Cinram Group Inc.), a subsidiary of Cinram
International, including on-site leased workers from
OneSource Staffing Solutions Olyphant, Pennsylvania (TA-W-
81,726), and Cinram Distribution, LLC, (currently doing
business as Cinram Group Inc.), a subsidiary of Cinram
International, including on-site leased workers from
Ambassador Personnel, Select Remedy Staffing and Wood
Personnel Services, Lavergne, Tennessee (TA-W-81,726A), who
became totally or partially separated from employment on or
after July 17, 2012, through July 25, 2014, and all workers
in the group threatened with total or partial separation
from employment on July 25, 2012 through July 25, 2014, are
eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended,
AND
All leased workers from ERG Staffing Service and AA
Temporary Services, Inc., working on-site at Cinram
Manufacturing, LLC, (currently doing business as Cinram
Group Inc.), Olyphant, Pennsylvania (TA-W-81,726B), and
leased workers from AFEEA, All-Star, and Elwood, working on-
site at Cinram Distribution, LLC, (currently doing business
as Cinram Group Inc.), Lavergne, Tennessee, (TA-W-81,726C),
who became totally or partially separated from employment on
or after June 14, 2011, through July 25, 2014, and all
workers in the group threatened with total or partial
separation from employment on July 25, 20142 through July
25, 2014, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on June 15, 2012 by a company official on behalf of workers
of Cinram Manufacturing, LLC, a subsidiary of Cinram
International, Olyphant, Pennsylvania and Cinram Distribution,
LLC, a subsidiary of Cinram International, LaVergne, Tennessee
(Cinram). The workers’ firm is engaged in activities related to
the production, packaging and distribution of optical media
devices (DVDs, CDs, and Blu-ray discs). The worker group includes
on-site leased workers from OneSource Staffing Solutions, ERG
Staffing Service, AA Temporary Services, Inc., AFEEA, All-Star,
Elwood, Ambassador Personnel, Select Remedy Staffing, and Wood
Personnel Services.
Workers of Cinram Manufacturing, LLC, including on-site
leased workers from OneSource Staffing Solutions, Olyphant,
Pennsylvania were certified for Trade Adjustment Assistance under
petition number TA-W-73,644 that expired on July 16, 2012. That
certification did not include leased workers from ERG Staffing
Service or AA Temporary Services, Inc.
Workers of Cinram Distribution, LLC, including on-site
leased workers from Ambassador Personnel, Select Remedy Staffing,
and Wood Personnel Services, LaVergne, Tennessee were certified
for Trade Adjustment Assistance under petition number TA-W-74,219
that also expired on July 16, 2012. That certification did not
include workers from AFEEA, All-Star, or Elwood.
During the course of the investigation, information was
collected from the workers’ firm and customers.
Section 222(a)(1) has been met because a significant number
or proportion of the workers in such workers’ firm have become
totally or partially separated, or are threatened to become
totally or partially separated.
Section 222(a)(2)(A)(i) has been met because sales of
optical media products by Cinram have decreased absolutely during
the relevant period.
Section 222(a)(2)(A)(ii) has been met because customer
imports of articles like or directly competitive with the
articles produced by Cinram have increased.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased customer imports of optical media products contributed
importantly to the worker group separations and sales declines at
Cinram.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Cinram Manufacturing,
LLC, a subsidiary of Cinram International, Olyphant, Pennsylvania
and Cinram Distribution, LLC, a subsidiary of Cinram
International, Lavergne, Tennessee, who are engaged in activities
related to the production, packaging, and distribution of optical
media products meet the worker group certification criteria under
Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance
with Section 223 of the Act, 19 U.S.C. § 2273, I make the
following certification:



“All workers of Cinram Manufacturing, LLC, a subsidiary of
Cinram International, including on-site leased workers from
OneSource Staffing Solutions Olyphant, Pennsylvania (TA-W-
81,726), and Cinram Distribution, LLC, a subsidiary of
Cinram International, including on-site leased workers from
Ambassador Personnel, Select Remedy Staffing and Wood
Personnel Services, Lavergne, Tennessee (TA-W-81,726A), who
became totally or partially separated from employment on or
after July 17, 2012, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended,








AND
All leased workers from ERG Staffing Service and AA
Temporary Services, Inc., working on-site at Cinram
Manufacturing, LLC, Olyphant, Pennsylvania (TA-W-81,726B),
and leased workers from AFEEA, All-Star, and Elwood, working
on-site at Cinram Distribution, LLC, Lavergne, Tennessee,
(TA-W-81,726C), who became totally or partially separated
from employment on or after June 14, 2011, through two years
from the date of certification, and all workers in the group
threatened with total or partial separation from employment
on the date of certification through two years from the date
of certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
