Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974,
as amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the
workers in such workers' firm have become totally or
partially separated, or are threatened to become
totally or partially separated;
(2)(B)(i)(I) there has been a shift by the workers'
firm to a foreign country in the production of
articles or supply of services like or directly
competitive with those produced/supplied by the
workers' firm; OR
(II) there has been an acquisition from a
foreign country by the workers' firm of
articles/services that are like or directly
competitive with those produced/supplied by
the workers' firm; AND
(ii) the shift/acquisition must have
contributed importantly to the workers'
separation or threat of separation.

The investigation was initiated in response to a petition
filed on March 15, 2012 by the Communications Workers of
America (CWA), Local 7777 on behalf of workers of Avaya Inc.,
8744 Lucent Boulevard, Global Support Services (GSS), a
division of Avaya Client Services (ACS), formerly known as
Avaya Global Services (AGS), also formerly known as the
Worldwide Services Group, Highlands Ranch, Colorado (TA-W-
81,421); Avaya Inc., 8740 Lucent Boulevard, Global Support
Services (GSS), a division of Avaya Client Services (ACS),
formerly known as Avaya Global Services (AGS), also formerly
known as the Worldwide Services Group, Highlands Ranch,
Colorado (TA-W-81,421B); Avaya Inc., Global Support Services
(GSS), a division of Avaya Client Services (ACS), formerly
known as Avaya Global Services (AGS), also formerly known as
the Worldwide Services Group, Westminster, Colorado (TA-W-
81,421C); Avaya Inc., Global Support Services (GSS), a

Worldwide Services Group, Basking Ridge, New Jersey (TA-W-
81,421I); Avaya Inc., Global Support Services (GSS), a
division of Avaya Client Services (ACS), formerly known as
Avaya Global Services (AGS), also formerly known as the
Worldwide Services Group, virtual offices located in the
states: Alabama, Arizona, Arkansas, California, Colorado,
Connecticut, Delaware, Florida, Georgia, Illinois, Indiana,
Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts,
Michigan, Minnesota, Missouri, Nebraska, Nevada, New
Hampshire, New Jersey, New York, North Carolina, Ohio,
Oklahoma, Oregon, Pennsylvania, South Carolina, Tennessee,
Texas, Utah, Virginia, Washington, And Wisconsin reporting to
Basking Ridge, New Jersey (TA-W-81,421J) ("Avaya"). The
workers' firm is engaged in activities related to the supply
of technical support services for Avaya communication systems'
products. The worker groups of Highlands Ranch, Colorado
under TA-W-81,421 consists of on-site leased workers from
Populus and Teksystems.
The worker group under petition numbers TA-W-81,421
through TA-W-81,421K, excluding TA-W-81,421A, was certified
eligible to apply for Trade Adjustment Assistance (TAA) under
petition number TA-W-70,405. The petition determination
expired on September 11, 2011. The worker group under
petition number TA-W-81,421C was certified eligible to apply
for TAA under petition number TA-W-71,090. The petition
determination expired on October 23, 2011. The leased worker
groups mentioned, Populus and TEKsystems, were not mentioned
in either determinations.
Furthermore, workers of Avaya Inc., Audio/Video, Global
Support Services (GSS), a division of Avaya Client Services
(ACS), formerly known as Avaya Global Services (AGS), also
formerly known as the Worldwide Services Group, Highlands
Ranch, Colorado; Avaya Inc., Audio/Video, Global Support
Services (GSS), a division of Avaya Client Services (ACS),
formerly known as Avaya Global Services (AGS), also formerly
known as the Worldwide Services Group, Oklahoma City, Oklahoma
have been excluded from this determination based on a recent
determination certifying workers eligible to apply for TAA
under petition number TA-W-81,365 on May 11, 2012. The
Audio/Video worker group is a subset under the GSS
organization.
During the course of the investigation, information was
collected from the workers' firm.
Section 222(a)(1) has been met because a significant
number or proportion of the workers in such workers' firm have
become totally or partially separated, or are threatened to
become totally or partially separated.
Section 222(a)(2)(B) has been met because the workers'
firm has shifted to a foreign country the supply of a service
like or directly competitive with the service supplied by the
workers which contributed importantly to worker group
separations at Avaya.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Avaya Inc., 8744
Lucent Boulevard, Global Support Services (GSS), a division of
Avaya Client Services (ACS), formerly known as Avaya Global
Services (AGS), also formerly known as the Worldwide Services
Group, including on-site leased workers from Populus and
TEKsystems (TA-W-81,421A), Highlands Ranch, Colorado (TA-W-
81,421); Avaya Inc., 8740 Lucent Boulevard, Global Support
Services (GSS), a division of Avaya Client Services (ACS),
formerly known as Avaya Global Services (AGS), also formerly
known as the Worldwide Services Group, Highlands Ranch,
Colorado (TA-W-81,421B); Avaya Inc., Global Support Services
(GSS), a division of Avaya Client Services (ACS), formerly
known as Avaya Global Services (AGS), also formerly known as
the Worldwide Services Group, Westminster, Colorado (TA-W-
81,421C); Avaya Inc., Global Support Services (GSS), a
division of Avaya Client Services (ACS), formerly known as
Avaya Global Services (AGS), also formerly known as the
Worldwide Services Group, Coppell, Texas (TA-W-81,421D); Avaya
Inc., Global Support Services (GSS), a division of Avaya

activities related to the supply of technical support services
for Avaya communication systems' products meet the worker
group certification criteria under Section 222(a) of the Act,
19 U.S.C. § 2272(a). In accordance with Section 223 of the

Trade Act of 1974, as amended,

All workers of Populus and TEKsystems, working on-site at
Avaya Inc., 8744 Lucent Boulevard, Global Support

(ACS), formerly known as Avaya Global Services (AGS),

Highlands Ranch, Colorado (TA-W-81,421A) who became

after March 14, 2011 through two years from the date of
certification, and all workers in the group threatened
with total or partial separation from employment on the
