Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on February 8, 2011 by three workers on behalf of workers
of Maine Military Authority, Defense, Veterans, and Emergency
Management Division, Augusta and Limestone, Maine. The workers
provide military vehicle repair and refurbishment services.
The workers allege that the public agency is acquiring
military vehicle repair and refurbishment services from a
foreign country. The investigation included analysis of data
provided by a public agency official.
The investigation revealed that Criterion (2) has not been
met because Maine Military Authority did not acquire military
vehicle repair and refurbishment services from a foreign
country.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Maine Military
Authority, Defense, Veterans, and Emergency Management
Division, Augusta and Limestone, Maine are denied eligibility
to apply for adjustment assistance under Section 223 of the Act,
19 U.S.C. § 2273.
