Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on March 11, 2011, applicable to workers of
Continental Plastics Company, including on-site leased workers
from ETS Staffing, Fraser, Michigan; Continental Plastics
Company, Chesterfield, Inc., including on-site leased workers
from ETS Staffing, Chesterfield, Michigan; Continental Coatings,
LLC, including on-site leased workers from ETS Staffing, China
Township, Michigan; and Continental Industries, LLC, including
on-site leased workers from Manpower and PMP Personnel Services,
Benzonia, Michigan. The workers produce automotive interior
trim. The notice was published in the Federal Register on March
23, 2011 (76 FR 16450).
At the request of the company, the Department reviewed the
certification for workers of the subject firm. New information
shows that workers leased from Labor Ready were employed on-site
at the Fraser, Michigan and Chesterfield, Michigan locations of
Continental Plastics Company and the China Township, Michigan
location of Continental Coatings, LLC. The Department has
determined that these workers were sufficiently under the control
of Continental Plastics Company and Continental Coatings, LLC to
be considered leased workers.
Information also shows that Magna will continue operations
at Continental Coatings and Continental Industries after their
closings due to an Asset Purchase Agreement (APA) finalized at
the end of May 2011. Some workers separated from employment at
the China Township, Michigan location of Continental Coatings,
LLC and the Benzonia, Michigan location of Continental
Industries, LLC have their wages reported under a separate
unemployment insurance (UI) tax account under the name Magna.
Based on these findings, the Department is amending this
certification to properly reflect these matters.
The amended notice applicable to TA-W-75,161, TA-W-75,161A,
TA-W-75,161B, TA-W-75,161C and TA-W-75,161D is hereby issued as
follows:
"All workers of Continental Plastics Company, including on-
site leased workers from ETS Staffing and Labor Ready,
Fraser, Michigan (TA-W-75,161); Continental Plastics
Company, including on-site leased workers from Randstad
Staffing & Recruiting, Alpharetta, Georgia (TA-W-75,161A);
Continental Plastics Company, Chesterfield, Inc., including
on-site leased workers from ETS Staffing and Labor Ready,
Chesterfield, Michigan (TA-W-75,161B); Continental Coatings,
LLC, doing business as Magna, including on-site leased workers
from ETS Staffing and Labor Ready, China Township, Michigan
(TA-W-75,161C); and Continental Industries, LLC, doing
business as Magna, including on-site leased workers from
Manpower and PMP Personnel Staffing, Benzonia, Michigan (TA-
W-75,161D), who became totally or partially separated from
employment on or after January 31, 2010 through March 11,
2013, and all workers in the group threatened with total or
partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act“), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a firm under
Section 222(c) of the Act, 19 U.S.C. § 2272(c), can be satisfied if
the following criteria are met:
I. a significant number or proportion of the workers in the
workers’ firm or an appropriate subdivision of the firm
have become totally or partially separated, or are
threatened to become totally or partially separated;

II. the workers’ firm is a Supplier or Downstream Producer to
a firm that employed a group of workers who received a
certification of eligibility under Section 222(a) of the
Act, 19 U.S.C. § 2272(a), and such supply or production
is related to the article or service that was the basis
for such certification; and

III. either
(A) the workers’ firm is a supplier and the component parts
it supplied to the firm described in paragraph (2)
accounted for at least 20 percent of the production or
sales of the workers’ firm; or
(B) a loss of business by the workers’ firm with the firm
described in paragraph (2) contributed importantly to the
workers’ separation or threat of separation.

Section 222(d) of the Act, 19 U.S.C. § 2272(d), defines the
term “Supplier” as “a firm that produces and supplies directly to
another firm component parts for articles, or services used in the
production of articles or in the supply of services, as the case
may be, that were the basis for a certification of eligibility
under subsection (a) [of Section 222 of the Act] of a group of
workers employed by such other firm.”
The investigation was initiated in response to a petition
filed on February 1, 2011 by a company official on behalf of
workers of Continental Plastics Company, Fraser, Michigan (TA-W-
75,161), Continental Plastics Company, Alpharetta, Georgia (TA-W-
75,161A), Continental Plastics Company, Chesterfield, Inc.,
Chesterfield, Michigan (TA-W-75,161B), Continental Coatings, LLC,
China Township, Michigan (TA-W-75,161C) and Continental Industries,
LLC, Benzonia, Michigan (TA-W-75,161D). All five groups will be
identified as “Continental Plastics” in this document. The
workers are engaged in activities related to the production of
automotive interior trim. TA-W-75,161, TA-W-75,161B and TA-W-
75,161C have on-site leased workers from ETS Staffing. TA-W-
75,161A has on-site leased workers from Randstad Staffing &
Recruiting. TA-W-75,161D has on-site leased workers from Manpower
and PMP Personnel Services.
The investigation revealed that workers of Continental
Plastics who are engaged in activities related to the production
of automotive interior trim meet the criteria as Suppliers for
secondary worker certification.
Criterion I has been met because a significant number or
proportion of the workers at Continental Plastics have become
totally or partially separated, or are threatened to become totally
or partially separated.
Criterion II has been met because workers of Continental
Plastics produced automotive interior trim that were directly
supplied to a firm with a currently certified Trade Adjustment
Assistance (TAA) worker group, and automotive interior trim
supplied was related to the production of articles that was the
basis for the TAA certification.
Criterion III has been met because the loss of business by
Continental Plastics with the TAA-certified firm, with respect to
automotive interior trim sold to the TAA-certified firm,
contributed importantly to worker separations at Continental
Plastics.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Continental Plastics
Company, including on-site leased workers from ETS Staffing,
Fraser, Michigan (TA-W-75,161), Continental Plastics Company,
including on-site leased workers from Randstad Staffing &
Recruiting, Alpharetta, Georgia (TA-W-75,161A), Continental
Plastics Company, Chesterfield, Inc., including on-site leased
workers from ETS Staffing, Chesterfield, Michigan (TA-W-75,161B),
Continental Coatings, LLC, including on-site leased workers from
ETS Staffing, China Township, Michigan (TA-W-75,161C) and
Continental Industries, LLC, including on-site leased workers
from Manpower and PMP Personnel Staffing, Benzonia, Michigan (TA-
W-75,161D), who are engaged in activities related to production of
automotive interior trim meet the worker group certification
criteria under Section 222(c) of the Act, 19 U.S.C. § 2272(c). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:
“All workers of Continental Plastics Company, including on-
site leased workers from ETS Staffing, Fraser, Michigan (TA-
W-75,161), Continental Plastics Company, including on-site
leased workers from Randstad Staffing & Recruiting,
Alpharetta, Georgia (TA-W-75,161A), Continental Plastics
Company, Chesterfield, Inc., including on-site leased workers
from ETS Staffing, Chesterfield, Michigan (TA-W-75,161B),
Continental Coatings, LLC, including on-site leased workers
from ETS Staffing, China Township, Michigan (TA-W-75,161C) and
Continental Industries, LLC, including on-site leased
workers from Manpower and PMP Personnel Staffing, Benzonia,
Michigan (TA-W-75,161D), who became totally or partially
separated from employment on or after January 31, 2010,
through two years from the date of certification, and all
workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are eligible
to apply for adjustment assistance under Chapter 2 of Title II
of the Trade Act of 1974, as amended.”
