Notice of Termination of Investigation


Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
January 14, 2011 on behalf of workers of IBM, Dept. HRUA, Bldg 002,
3039 Cornwallis Road, Research Triangle Park, North Carolina.
A petition must be filed by a group of three or more
workers, a company or public agency official, a representative
from a One-Stop operators or partners, or a union or other duly
authorized representative of such workers, to be valid.
The petitioner identified himself as "Other Authorized
Representative" and the worker group as "myself." The petitioner
is not a duly authorized representative and "myself" does not meet
the definition of a worker group, which is defined in 29 CFR 90.2
as "three or more workers in a firm or an appropriate subdivision."
Therefore, the petition regarding the investigation has been deemed
invalid. Consequently, the investigation has been terminated.
