Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on December 10, 2010 on behalf of workers of the City of
Walla Walla, Development Services Department, Walla Walla,
Washington. The workers supply development services such as
permitting, planning, building inspection and code enforcement
for the city of Walla Walla, Washington.
The petitioners claimed that the global recession coupled
with low city tax revenues led to worker separations. The
investigation included analysis of data provided by the public
agency.
With regard to Section 222(b) of the Act, the investigation
revealed that Criterion (2) has not been met because the City of
Walla Walla did not acquire from a foreign country services like
or directly competitive to the services supplied by the
Development Services Department.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of City of Walla Walla,
Development Services Department, Walla Walla, Washington, who
supply development services, are denied eligibility to apply
for adjustment assistance under Section 223 of the Act, 19
U.S.C. § 2273.
