Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on January 12, 2011, applicable to workers
of Wellpoint, Inc., Enterprise Provider Data Management Team,
including on-site leased workers from Kelly Services and
Jacobsen Group, Indianapolis, Indiana. The workers provide
health insurance transactional services. The notice was
published in the Federal Register on January 26, 2011 (76 FR
4731). The certification was amended on March 30, 2011 to
include workers from auxiliary facilities in multiple states who
were similarly affected by the acquisition of services that
contributed importantly to separations at the Indianapolis,
Indiana facility. The amended certification will be published
soon in the Federal Register.
At the request of a State agency, the Department reviewed
the amended certification for workers of the subject firm.
A review of the amended certifications shows that workers
of Wellpoint, Inc., d/b/a Anthem East, Enterprise Provider Data
Management Team, South Portland, Maine (TA-W-895H) are currently
covered under an existing certification, TA-W-74,299, that
expires on August 2, 2012.
Accordingly, the Department is amending this certification
to delete TA-W-895H. The other locations covered by the amended
certification are unaffected.
The amended notice applicable to TA-W-74,895 is hereby
issued as follows:
“All workers of Wellpoint, Inc., d/b/a Anthem Blue Cross &
Blue Shield, Enterprise Provider Data Management Team,
including on-site leased workers from Kelly Services and
Jacobsen Group, Indianapolis, Indiana (TA-W-74,895),

Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of
1974, as amended (“Act”), 19 U.S.C. § 2273, the Department of
Labor issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on January 12, 2011, applicable to workers
of Wellpoint, Inc., Enterprise Provider Data Management Team,
including on-site leased workers from Kelly Services and
Jacobsen Group, Indianapolis, Indiana. The workers provide
health insurance transactional services. The notice was
published in the Federal Register on January 26, 2011 (76 FR
4731).
At the request of the State agency, the Department reviewed
the certification for workers of the firm. New findings show
that worker separations occurred during the relevant time period
at the above mentioned locations of Wellpoint, Inc., Enterprise
Provider Data Management Team. Each location operates in
conjunction with the Indianapolis, Indiana location. All were
part of the overall servicing operation and were impacted by the
firm shifting health insurance transactional services to a
foreign country.
Accordingly, the Department is amending this certification
to include workers at the above mentioned locations of
Wellpoint, Inc., Enterprise Provider Data Management Team. The
intent of the Department’s certification is to include all
workers of the firm who were adversely affected by a shift of
health insurance transactional services to a foreign country.
The amended notice applicable to TA-W-74,895 is hereby
issued as follows:
“All workers of Wellpoint, Inc., d/b/A Anthem Blue Cross &
Blue Shield, Enterprise Provider Data Management Team,

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
I. The first criterion (set forth in Section 222(a)(1) of the
Act, 19 U.S.C. § 2272(a)(1)) requires that a significant
number or proportion of the workers in the workers’ firm
must have become totally or partially separated or be
threatened with total or partial separation.

II. The second criterion (set forth in Section 222(a)(2) of the
Act, 19 U.S.C. § 2272(a)(2)) may be satisfied if either:

(i)(I) there has been a shift by the workers’ firm to a
foreign country in the production of articles or
supply of services like or directly competitive with
those produced/supplied by the workers’ firm; OR
(i)(II) there has been an acquisition from a foreign
country by the workers’ firm of articles/services that
are like or directly competitive with those
produced/supplied by the workers’ firm.

III. The third criterion requires that the shift/acquisition
must have contributed importantly to the workers’
separation or threat of separation. See Section
222(a)(2)(B)(ii) of the Act, 19 U.S.C. §
2272(a)(2)(B)(ii).

The investigation was initiated in response to a petition
filed on November 19, 2010 on behalf of workers of Wellpoint,
Inc., Enterprise Provider Data Management Team, Indianapolis,
Indiana. The workers provide health insurance transactional
services. The worker group includes on-site leased workers
from Kelly Services and Jacobsen Group.
The investigation revealed that workers of Wellpoint, Inc.,
Enterprise Provider Data Management Team, who are engaged in
employment related to health insurance transactional services,
meet the criteria for certification.
Criterion I has been met because a significant number of
workers have been totally or partially separated over the
relevant period.
Criterion II has been satisfied because the workers’ firm
has acquired from a foreign country services like or directly
competitive with the services supplied by the firm.
Criterion III has been met because the acquisition of
services by Wellpoint, Inc. contributed importantly to worker
group separations in the Enterprise Provider Data Management
Team, Indianapolis, Indiana.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Wellpoint, Inc.,
Enterprise Provider Data Management Team, Indianapolis,
Indiana, who are engaged in employment related to health
insurance transactional services, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
“All workers of Wellpoint, Inc., Enterprise Provider Data
Management Team, including on-site leased workers of
Kelly Services and Jacobsen Group, Indianapolis, Indiana,
who became totally or partially separated from employment
on or after November 15, 2009, through two years from the
date of certification, and all workers in the group
threatened with total or partial separation from employment
on the date of certification through two years from the
date of certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
