Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on December 28, 2010, applicable to workers and former
workers of StarTek USA, Inc., Greeley, Colorado. The Department’s
notice of determination was published in the Federal Register on
January 14, 2011 (76 FR 2717).
Based on new information provided subsequent to the issuance
of the determination, the Department reviewed the certification
for workers of the subject firm.
New information shows that there are two StarTek USA, Inc.
facilities in Greeley, Colorado (the “west” center at 244 Dundee
Avenue and the “north” center at 1250 H Street); both facilities
supply business processes services and operate in conjunction
with each other.
Accordingly, the Department is amending this certification
to properly reflect this matter.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by
increased imports of like or directly competitive services.
The amended notice applicable to TA-W-74,850 is hereby
issued as follows:
"All workers of StarTek USA, Inc., 244 Dundee Avenue,
Greeley, Colorado (TA-W-74,850) and StarTek USA, Inc., 1250
H Street, Greeley, Colorado (TA-W-74,850A), who became
totally or partially separated from employment on or after
November 5, 2009, through December 28, 2012, and all workers
in the group threatened with total or partial separation
from employment on December 28, 2010 through two years from
the date of certification, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the
Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance


In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification
of eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on November 9, 2010 by a State Trade Adjustment Assistance
Coordinator, on behalf of workers of StarTek USA, Inc., Greeley,
Colorado (STarTek). The workers supply business processes
services related to long distance telephone calls. The worker
group does not include any leased or temporary workers, and all
workers are cross-trained to support the supply of business
processes.
The investigation revealed that workers of StarTek, who
supply business processes services, meet the criteria for
certification.
Section 222(a)(1) has been met because a significant number
or proportion of the workers at StarTek has become totally or
partially separated, or threatened with such separation, during
the relevant period.
Section 222(a)(2)(A)(i) has been met because StarTek sales
and/or production have decreased during the relevant time period.
Section 222(a)(2)(A)(ii) has been met because a major
declining customer of the subject firm has awarded a contract to
a competitor who is supplying from a foreign country services
like or directly competitive with those supplied by the subject
firm.
Finally, Section 222(a)(2)(A)(iii) was not met because the
increased imports of like or directly competitive services
contributed importantly to worker separations at the Greeley,
Colorado facility.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of StarTek USA, Inc.,
Greeley, Greeley, Colorado, who are engaged in employment related
to the supply of business process services, meet the worker group
certification criteria under Section 222(a) of the Act, 19 U.S.C.
§ 2272(a). In accordance with Section 223 of the Act, 19 U.S.C. §
2273, I make the following certification:
“All workers of StarTek USA, Inc., Greeley, Colorado, who
became totally or partially separated from employment on or
after November 5, 2009, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
