Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
October 6, 2010 on behalf of workers of Bank of America Card
Customer Assistance Division, 2568 Park Center Boulevard, State
College, Pennsylvania. The workers are "call center associate" who
supply "card services." The petitioners allege that "telesales
and customer servicing jobs that we were trained and hired for
are being performed in call centers that have opened overseas"
and that the subject facility closed on June 30, 2010. The
petition did not include any supporting documents.
On September 3, 2010, the Department issued a negative
determination (TA-W-74,246) applicable to workers of Bank of
America, Card Customer Assistance Division, 2568 Park Center
Boulevard, State College, Pennsylvania, who supplied credit card
customer assistance until the call center closed on June 30, 2010.
Based on information supplied on the petition TA-W-74,697 and
information obtained during the investigation of TA-W-74,246, the
Department determines that the worker group covered by TA-W-74,697
is the same as the worker group covered by TA-W-74,246.
In the determination of TA-W-74,246, the Department stated
that the subject firm did not shift to/acquire from another country
services like or directly competitive with those supplied at the
customer assistance services supplied by the subject workers, but
had relocated the supply of services to other facilities in the
United States.
Petition TA-W-74,697 (dated September 15, 2010) does not
contain any new information or allege a change in circumstances
which would result in a reversal of the Department's previous
determination (TA-W-74,246; issued on September 3, 2010).
Consequently, further investigation would serve no purpose, and the
investigation has been terminated.
