Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on November 5, 2010, applicable to workers
of DST Systems, Inc. (DST), including on-site leased workers
from Comsys Information Technology Services, Megaforce, and
Kelly Services, Kansas City, Missouri. The workers supply
technical services to the financial services communications and
healthcare industries. The Department’s Notice was published in
the Federal Register on November 18, 2011 (76 FR 70701).
The Notice was amended on May 24, 2011 to include the
Boston, Massachusetts location. The amended Notice was
published in the Federal Register on June 3, 2011 (76 FR 32227).
The Department reviewed the certification for workers of
the subject firm as a result of information supplied by a
company official during an investigation pursuant to a TAA
petition filed on behalf of workers of the South Windsor,
Connecticut location of DST.
The South Windsor, Connecticut location of DST operated in
conjunction with the Kansas City, Missouri location of DST; both
locations are part of the overall servicing operation, served
the same customer base, and are impacted by a shift in the
supply of services abroad.
Accordingly, the Department is amending this certification
to include workers of the South Windsor, Connecticut location of
DST. The amended notice applicable to TA-W-74,649 is hereby
issued as follows:







“All workers of DST Systems, Inc., including on-site leased
workers from Comsys Information Technology Services,
Megaforce, and Kelly Services, Kansas City, Missouri (TA-W-
74,649), DST Technologies, a wholly owned subsidiary of DST
Systems, Inc., Boston, Massachusetts (TA-W-74,649A), and
DST Output East, LLC, a wholly owned subsidiary of DST
Systems, Inc., South Windsor, Connecticut (TA-W-74,649B),
who became totally or partially separated from employment
on or after September 21, 2009, through November 5, 2012,
and all workers in the group threatened with total or
partial separation from employment on date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended.”

Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
(Department) issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on November 5, 2010, applicable to
workers of DST Systems, Inc., including on-site leased workers
from Comsys Information Technology Services, Megaforce, and
Kelly Services, Kansas City, Missouri (subject firm). The
workers supply technical services, such as sophisticated
information processing, computer software services, and business
solutions, to the financial services, communications, and
healthcare industries. The Department’s Notice was published in
the Federal Register on November 18, 2011 (76 FR 70701).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm.
DSI Technologies, a wholly owned subsidiary of DSI Systems,
Inc., Boston, Massachusetts operated in conjunction with the
Kansas City, Missouri location of DSI Systems, Inc.; both
locations are part of an overall servicing operation, serve the
same customer base, and are impacted by a shift in the supply of
services abroad. Accordingly, the Department is amending this
certification to include workers of DSI Technologies, Boston,
Massachusetts.
The amended notice applicable to TA-W-74,649 is hereby
issued as follows:
“All workers of DST Systems, Inc., including on-site leased
workers from Comsys Information Technology Services,
Megaforce, and Kelly Services, Kansas City, Missouri (TA-W-
74,649) and DST Technologies, a wholly owned subsidiary of
DST Systems, Inc., Boston, Massachusetts (TA-W-74,649A),
who became totally or partially separated from employment
on or after September 21, 2009, through November 5, 2012,
and all workers in the group threatened with total or
partial separation from employment on date of certification
through two years from the date of certification, are


eligible to apply for adjustment assistance under Chapter 2
of Title II of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
I. The first criterion (set forth in Section 222(a)(1) of the
Act, 19 U.S.C. § 2272(a)(1)) requires that a significant
number or proportion of the workers in the workers’ firm
must have become totally or partially separated or be
threatened with total or partial separation.

II. The second criterion (set forth in Section 222(a)(2) of the
Act, 19 U.S.C. § 2272(a)(2)) may be satisfied if either:

(i)(I) there has been a shift by the workers’ firm to a
foreign country in the production of articles or
supply of services like or directly competitive with
those produced/supplied by the workers’ firm; OR
(i)(II) there has been an acquisition from a foreign
country by the workers’ firm of articles/services that
are like or directly competitive with those
produced/supplied by the workers’ firm.

III. The third criterion requires that the shift/acquisition
must have contributed importantly to the workers’
separation or threat of separation. See Section
222(a)(2)(B)(ii) of the Act, 19 U.S.C. §
2272(a)(2)(B)(ii).

The investigation was initiated in response to a petition
filed on September 22, 2010 on behalf of workers of DST
Systems, Inc., Kansas City, Missouri (subject firm). The
workers supply technical services (sophisticated information
processing, computer software services and business solutions)
to the financial services, communications and healthcare
industries.
The worker group includes on-site leased workers from
Comsys Information Technology Services, Megaforce, and Kelly
Services.
The investigation revealed that workers of the subject
firm, who are engaged in activities related to the supply of
technical services, meet the criteria for certification.
Criterion I has been met because a significant number of
workers at the subject firm was totally or partially separated
or threatened with such separation.
Criterion II has been met because the workers’ firm has
shifted to foreign countries the supply of services like or
directly competitive with the technical services supplied by
the subject workers.
Criterion III has been met because the shift to India and
Thailand contributed importantly to worker group separations
at the Kansas City, Missouri facility.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of DST Systems, Inc.,
Kansas City, Missouri, who are engaged in activities related to
the supply of technical services, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
“All workers of DST Systems, Inc., including on-site leased
workers from Comsys Information Technology Services,
Megaforce, and Kelly Services, Kansas City, Missouri, who
became totally or partially separated from employment on or
after September 21, 2009, through two years from the date
of certification, and all workers in the group threatened
with total or partial separation from employment on date of
certification through two years from the date of


certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
