Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on July 1, 2010 by the American Federation of State,
County and Municipal Employees (AFSCME), Council 31 on behalf
of workers of Madison County Employment & Training, Wood River,
Illinois (TA-W-74,331); Madison County Employment & Training,
Field Office, Granite City, Illinois (TA-W-74,331A); Madison
County Employment & Training, Field Office, Alton, Illinois
(TA-W-74,331B); Madison County Employment & Training, Field
Office, Edwardsville, Illinois (TA-W-74,331C); Madison County
Employment & Training, Field Office, Glen Carbon, Illinois
(TA-W-74,331D) [Madison County Employment and Training]. The
workers are engaged in activities related to the supply of
career counseling and training services to low-income youth
and adults.
The petitioner alleged that worker separations are due to
the loss of jobs and production to manufacturing companies', due
to offshoring, which has resulted in a trickle down effect which
has caused an actual decline to downstream firms and tax
revenue.
The investigation revealed that criterion (2) has not been
met. Madison Employment and Training has not acquired from a
foreign country services that are like or directly competitive
with services which are supplied by Madison County Employment
and Training.
Furthermore, as it relates to the petitioner's allegation,
Madison County Employment and Training can not be considered as
a Secondary Worker as defined. Section 222(d) of the Act, 19
U.S.C. § 2272(d), defines the term "Supplier as a firm that
produces and supplies directly to another firm (or subdivision)
component parts for articles or supply services used in the
production of articles or in the supply of services and the term
"Downstream Producer" as a firm that performs additional, value-
added production processes or services (final assembly,
finishing, testing, packaging, or maintenance or transportation
services) directly for another firm for articles or services
that was the basis for a primary certification.






Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Madison County
Employment & Training, Wood River, Illinois (TA-W-74,331);
Madison County Employment & Training, Field Office, Granite
City, Illinois (TA-W-74,331A); Madison County Employment &
Training, Field Office, Alton, Illinois (TA-W-74,331B);
Madison County Employment & Training, Field Office,
Edwardsville, Illinois (TA-W-74,331C); Madison County
Employment & Training, Field Office, Glen Carbon, Illinois
(TA-W-74,331D), who are engaged in activities related to the
supply of career counseling and training services are denied
eligibility to apply for adjustment assistance under Section 223
of the Act, 19 U.S.C. § 2273.
