Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on April 30, 2010 on behalf of workers of Mohican
Juvenile Correctional Facility (1012 ODNR Mohican 51)
Perrysville, Ohio, 44864. The workers supply juvenile
correctional institution operations and management services at
a state-funded correctional facility.
The petition states: "Our state correctional facility was
funded by income tax dollars. Due to the large amount of
companies closing due to foreign trade, our facility had to
close since the workers that paid income tax are now
unemployed and not paying Ohio income tax."
The investigation included various telephone calls with
the petitioners and information gathered from official
government sources.
The investigation revealed that Criterion (B)(2) has not
been met because the public agency did not acquire any
services from a foreign country.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Mohican Juvenile
Correctional Facility, Perrysville, Ohio are denied eligibility
to apply for adjustment assistance under Section 223 of the Act,
19 U.S.C. § 2273.
