Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on November 12, 2010, applicable to workers of First
American Title Insurance Company, including workers whose wages
were reported under National Default Title Services, including
on-site leased workers from, Remedy/Select, Waterloo, Iowa. The
workers supplied administrative, document preparation, recording,
and mail processing services. The notice was published in the
Federal Register on November 23, 2010 (75 FR 71460).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The company
reports that workers leased from Workway Professional Staffing
were employed on-site at the Waterloo, Iowa location of First
American Title Insurance Company, including workers whose wages
were reported under National Default Title Services. The
Department has determined that these workers were sufficiently
under the control of National Default Title Service to be
considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Workway Professional
Staffing working on-site at the Waterloo, Iowa location of First
American Title Insurance Company, including workers whose wages
were reported under National Default Title Services.


The amended notice applicable to TA-W-73,900A is hereby
issued as follows:

“All workers of First American Title Insurance Company
including workers whose wages were reported under National
Default Title Services working on-site at GMAC Mortgage LLC,
including on-site leased workers from Workway Professional
Staffing Santa Ana, California (TA-W-73,900) and workers of
First American Title Insurance Company including workers
whose wages were reported under National Default Title
Services working on-site at GMAC Mortgage LLC, including on-
site leased workers from Workway Professional Staffing and
Remedy/Select, Waterloo, Iowa (TA-W-73,900A), who became
totally or partially separated from employment on or after
April 9, 2009, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on April 12, 2010 on behalf of workers of First American
Title Insurance Company, including workers whose wages were
reported under National Default Title Services working on-site at
GMAC Mortgage LLC, Santa Ana, California (TA-W-73,900) and
Waterloo, Iowa (TA-W-73,900A). Workers who were not working on-
site at GMAC Mortgage LLC are excluded from the subject group. The
subject worker group is engaged in employment related to the
supply of administrative, document preparation, recording, and
mail processing services.
The subject worker group includes on-site leased workers from
Workway Professional Staffing (TA-W-73,900) and Rememdy/Select (TA-
W-73,900A).
The investigation revealed that workers of First American
Title Insurance Company working on-site at GMAC Mortgage LLC in
Santa Ana, California and Waterloo, Iowa, who are engaged in
employment related to the supply of administrative, document
preparation, recording, and mail processing services, meet the
criteria for certification.
Section 222(a)(1) has been met because a significant
proportion or number of the subject worker group at each facility
(Santa Ana, California and Waterloo, Iowa) has been totally or
partially separated, or threatened with such separation, during
the relevant period.
Section 222(a)(2)(A)(i) has been met because the sales of
administrative, document preparation, recording, and mail
processing services by First American Title Insurance Company
have decreased absolutely during the relevant period.
Section 222(a)(2)(A)(ii) has been met because imports of
services like or directly competitive with the administrative,
document preparation, recording, and mail processing services
supplied by First American Title Insurance Company have increased
during the relevant period.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased customer imports contributed importantly to the worker
group separations and sales declines at First American Title
Insurance Company, Santa Ana, California and First American Title
Insurance Company, Waterloo, Iowa.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of First American Title
Insurance Company, including workers whose wages were reported
under National Default Title Services, working on-site at GMAC
Mortgage LLC, Santa Ana, California (TA-W-73,900) and Waterloo,
Iowa (TA-W-73,900A), who are engaged in employment related to the
supply of administrative, document preparation, recording, and
mail processing services, meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:
“All workers of First American Title Insurance Company
including workers whose wages were reported under National
Default Title Services working on-site at GMAC Mortgage LLC,
including on-site leased workers from Workway Professional
Staffing Santa Ana, California (TA-W-73,900) and workers of
First American Title Insurance Company including workers
whose wages were reported under National Default Title
Services working on-site at GMAC Mortgage LLC, including on-
site leased workers from Remedy/Select, Waterloo, Iowa (TA-
W-73,900A), who became totally or partially separated from
employment on or after April 9, 2009, through two years from
the date of certification, and all workers in the group
threatened with


total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
