Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
February 19, 2010 by three workers on behalf of workers and former
workers of Nortel Networks, LTD, Richardson, Texas.
The petition states that "Nortel has indicated that it does
not intend to emerge out of Chapter 11 as a single entity and all
divisions will be auctioned through a court supervised process.
Jobs are being off-shored to Turkey/Mexico. This petition is
intended to cover the Richardson, Texas location all of its
employees." The petition further states that workers at the
Richardson, Texas facility are engaged in employment related to
"Telecommunication Products and Services."
29 CFR 90.11 states that a petition for Trade Adjustment
Assistance "shall clearly state the group of workers on whose
behalf the petition is filed," and defines a group to mean "three
or more workers in a firm or an appropriate subdivision thereof"
and defines appropriate subdivision to mean "an establishment in
a multi-establishment firm which produces the domestic article in
question or a distinct part or section of an establishment . . .
where the articles are produced."
Information obtained during the investigation of other
Nortel Networks, Richardson, Texas petitions (TA-W-70,897, Nortel
Networks, CNM and Tools Release Division and Network Management
Platform; TA-W-72,340, Nortel Networks, Adaptive Applications
Engine Department; TA-W-72,889, Nortel Networks, Ltd., GSM/UMTS
Voice & Packet Core Department, Carrier Networks Business Unit; TA-
W-72,890, Nortel Networks, Ltd., 4G LTE; and TA-W-73,008, Nortel
Networks, LTD, CDMA Core Development, Carrier Network
Organization) show that workers at the Richardson, Texas facility
are separately identifiable by distinct subgroups (by unit,
department, and organization).
During the investigation, the Department received confirmed
information that the three workers do not belong to the same
subgroup. Therefore, the Department determines that the
petitioners do not represent a worker group, for purposes of the
Trade Act of 1974, as amended, and that the petition does not
meet the acceptance criteria under 29 CFR 90. Consequently, the
investigation has been terminated.
