Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
(Department) issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on March 11, 2010, applicable to
workers and former workers of Siemens Medical Solutions USA,
Inc. (Seimens), Oncology Care Systems Division, Concord,
California (subject firm). The Department’s Notice of
determination was published in the Federal Register on April
23, 2010 (75 FR 21355). The Department’s Notice was amended
on July 29, 2011 to include the Malvern, Pennsylvania location
in support of the subject firm. The amended notice was
published in the Federal Register on August 12, 2011 (76 FR
50269). The workers are engaged in employment related to the
supply of administrative services.
At the request of workers, the Department reviewed the
certification for workers of the subject firm.
New information provided by company revealed that worker
separations have occurred involving off-site area office
employees located throughout the United States who report to the
Malvern, Pennsylvania location of Siemens Medical Solutions USA,
Inc., Global Services/Supply Chain Management. These employees
provided support for the supply of information technology
services (such as help desk, application development and
support, and data center operations) for the Malvern,
Pennsylvania location of the subject firm.
Based on these findings, the Department is amending the
certification to include employees of the subject firm who
reports to Malvern, Pennsylvania facility working at off-site
locations throughout the United States.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by a
shift in services to Germany.


The amended notice applicable to TA-W-73,158 is hereby
issued as follows:
“All workers of Siemens Medical Solutions USA, Inc.,
Oncology Care Systems Division, Concord, California (TA-
W-73,158) and Seimens Medical Solutions USA, Inc., Global
Services/Supply Chain Management, including employees
working at off-site locations throughout the United States,
reporting to Malvern, Pennsylvania, Malvern, Pennsylvania
(TA-W-73,158A), who became totally or partially separated
from employment on or after December 22, 2008, through
March 11, 2012, and all workers in the groups threatened
with total or partial separation from employment on March
11, 2010 through two years from the date of certification,
are eligible to apply for adjustment assistance under
Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Amended Certification Regarding Eligibility to

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
(Department) issued a Certification of Eligibility to Apply for
Worker Adjustment Assistance on March 11, 2010, applicable to
workers and former workers of Siemens Medical Solutions USA,
Inc. (Seimens), Oncology Care Systems Division, Concord,
California (subject firm). The workers are engaged in
employment related to the supply of administrative services.
The Department’s Notice of determination was published in the
Federal Register on April 23, 2010 (75 FR 21355).
At the request of workers, the Department reviewed the
certification for workers of the subject firm.
New information provided by Seimens reveals that workers of
Global Services/Supply Chain Management, Malvern, Pennsylvania,
provided support to several Siemens facilities, including but
not limited to, the Concord, California facility (TA-W-73,158).
Global Services/Supply Chain Management, Malvern, Pennsylvania
supplies information technology services (such as help desk,
application development and support, and data center operations)
in support of Seimens.
Based on these findings, the Department is amending the
certification to include workers of the Global Services/Supply
Chain Management, Malvern, Pennsylvania facility of Siemens
Medical Solutions USA, Inc. (TA-W-73,158A). The worker group
at the Malvern, Pennsylvania facility does not include on-site
leased workers from temporary agencies.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by a
shift in services to Germany.
The amended notice applicable to TA-W-73,158 is hereby
issued as follows:






“All workers of Siemens Medical Solutions USA, Inc.,
Oncology Care Systems Division, Concord, California (TA-
W-73,158) and Seimens Medical Solutions USA, Inc., Global
Services/Supply Chain Management, Malvern, Pennsylvania
(TA-W-73,158A), who became totally or partially separated
from employment on or after December 22, 2008, through
March 11, 2012, and all workers in the groups threatened
with total or partial separation from employment on March
11, 2010 through two years from the date of certification,
are eligible to apply for adjustment assistance under
Chapter 2 of Title II of the Trade Act of 1974, as
amended.”.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
I. The first criterion (set forth in Section 222(a)(1) of the
Act, 19 U.S.C. § 2272(a)(1)) requires that a significant
number or proportion of the workers in the workers’ firm
must have become totally or partially separated or be
threatened with total or partial separation.

II. The second criterion (set forth in Section 222(a)(2) of the
Act, 19 U.S.C. § 2272(a)(2)) may be satisfied if either:

(i)(I) there has been a shift by the workers’ firm to a
foreign country in the production of articles or
supply of services like or directly competitive with
those produced/supplied by the workers’ firm; OR
(i)(II) there has been an acquisition from a foreign
country by the workers’ firm of articles/services that
are like or directly competitive with those
produced/supplied by the workers’ firm.




III. The third criterion requires that the shift/acquisition
must have contributed importantly to the workers’
separation or threat of separation. See Section
222(a)(2)(B)(ii) of the Act, 19 U.S.C. §
2272(a)(2)(B)(ii).

The investigation was initiated in response to a petition
filed on December 28, 2009 by a company official on behalf of
workers of Siemens Medical Solutions USA, Inc., Oncology Care
Systems Division, Concord, California (Siemens). The workers
are engaged in activities related to the supply of
administrative services, specifically logistics, planning, and
financial services.
The investigation revealed that workers of Siemens who are
engaged in activities related to the supply of administrative
services meet the criteria for certification.
Criterion I has been met because a significant number or
proportion of the workers have been totally or partially
separated or threatened with separation.
Criterion II has been satisfied because the workers’ firm
has shifted to Germany the service like or directly
competitive with the service provided by the workers.
Criterion III has been met because the shift of
administrative services to Germany by Siemens contributed
importantly to worker group separations at Siemens.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Siemens Medical
Solutions USA, Inc., Oncology Care Systems Division, Concord,
California, who are engaged in activities related to the supply
of administrative services, specifically logistics, planning,
and financial services, meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a).
In accordance with Section 223 of the Act, 19 U.S.C. § 2273, I
make the following certification:
“All workers of Siemens Medical Solutions USA, Inc.,
Oncology Care Systems Division, Concord, California, who
became totally or partially separated from employment on or
after December 22, 2008, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
