Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on December 16, 2009, on behalf of workers of Marine
Corps Logistics Base, Barstow, California. The workers were
hired to provide military vehicle repair services. The
petitioners allege that military vehicle repair services were
shifted to a foreign country.
The investigation established that criterion (2) has not
been met because the public agency has not acquired services
from a foreign country like or directly competitive with
military vehicle repair services supplied by Marine Corps
Logistics Base, Barstow, California. Rather, the investigation
established that the worker group was separated before the
Barstow, California facility could supply the specific military
vehicle repair services for which the worker group was hired.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Marine Corps
Logistics Base, Barstow, California, related to military
vehicle repair services, are denied eligibility to apply for
adjustment assistance under Section 223 of the Act, 19 U.S.C. §
2273.
