Notice of Termination of Investigation

Pursuant to Section 221 of the Trade Act of 1974, as amended,
an investigation was initiated in response to a petition filed on
December 1, 2009 on behalf of workers and former workers of
Hewlett Packard, working on-site at Ryder Logistics,
Indianapolis, Indiana.
29 CFR 90.11 states that a petition for Trade Adjustment
Assistance "shall clearly state the group of workers on whose
behalf the petition is filed," and defines a group to mean "three
or more workers in a firm or an appropriate subdivision thereof"
and defines appropriate subdivision to mean "an establishment in
a multi-establishment firm . . . or a distinct part or section of
an establishment . . . where the articles are produced."



Information obtained during the investigation reveals that
workers at the subject facility are separately identifiable by
distinct subgroup and that the three workers do not belong to the
same subgroup. Therefore, the Department determines that the
petitioners do not represent a worker group and that the petition
does not meet the acceptance criteria under 29 CFR 90.
Consequently, the investigation has been terminated.
