Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on January 29, 2010, applicable to workers of Norgren
Automation Solutions, Erie Engineering and Automation Division, a
subsidiary of Norgren, Inc., Clinton Township, Michigan. The
notice was published in the Federal Register on March 5, 2010 (75
FR 10320).
At the request of the state, the Department reviewed the
certification for workers of the subject firm. The workers
produced automation design and build components.
New information shows that in April 2009 Norgren Automation
Solutions purchased Syron Engineering. Some workers separated
from employment at the subject firm had their wages reported
under a separated unemployment insurance (UI) tax account under
the name Syron Engineering.
Accordingly, the Department is amending this certification
to property reflect this matter.
The intent of the Department’s certification is to include
all workers of the subject firm who were adversely affected by an
increase in imports of automation design and build components.
The amended notice applicable to TA-W-72,524 is hereby
issued as follows:
"All workers of Norgren Automation Solutions, including
workers whose unemployment insurance (UI) wages are paid
through Syron Engineering, Erie Engineering and Automation
Division, a subsidiary of Norgren, Inc., Clinton Township,
Michigan, who became totally or partially separated from who
became totally or partially separated from employment on or
after October 1, 2008, through January 29, 2012, and all
workers in the group threatened with total or partial
separation from employment on date of certification through
two years from the date of certification, are eligible to
apply for adjustment assistance under Chapter 2 of Title II
of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on October 7, 2009 on behalf of workers of Norgren Automation
Solutions, Erie Engineering and Automation Division, a subsidiary
of Norgren Inc., Clinton Township, Michigan (Norgren Automation
Solutions). The workers are engaged in employment related to the
production of automation design and build components. The
components include die design, end of arm tooling, transfer
fingers, double blank protectors systems, cross bar tooling, steel
face sensors, clamps, grippers, pneumatic equipment, and transfer
equipment.
The workers are not separately identifiable by product line.
The worker group does not include on-site leased workers.
The investigation revealed that workers of Norgren Automation
Solutions who are engaged in employment related to automation
design and build components meet the criteria for certification.

Section 222(a)(1) has been met because a significant portion
of workers have been separated at the subject firm during January
through September 2009 when compared with the corresponding 2008
period.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of automation design and build components by
Norgren Automation Systems have decreased absolutely in January
through September 2009 when compared with the corresponding 2008
period.
Section 222(a)(2)(A)(ii) has been met because imports of
articles or services like or directly competitive with automation
design and build components by Norgren Automation Solutions have
increased.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased imports of automation design and build components by
customers of Norgren Automation Solutions contributed importantly
to the worker group separations and sales/production declines at
Norgren Automation Solutions.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Norgren Automation
Solutions, Erie Engineering and Automation Division, a subsidiary
of Norgren Inc., Clinton Township, Michigan, who are engaged in
employment related to automation design and build components meet
the worker group certification criteria under Section 222(a) of the
Act, 19 U.S.C. § 2272(a).



In accordance with Section 223 of the Act, 19 U.S.C. § 2273, I
make the following certification:
“All workers of Norgren Automation Solutions, Erie Engineering
and Automation Division, a subsidiary of Norgren Inc., Clinton
Township, Michigan, who became totally or partially separated
from employment on or after October 1, 2008, through two
years from the date of certification, and all workers in the
group threatened with total or partial separation from
employment on the date of certification through two years from
the date of certification, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the
Trade Act of 1974, as amended.”
