Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on July 7, 2010, applicable to workers of General
Motors Company, formerly known as General Motors Corporation,
Willow Run Transmission Plant, Ypsilanti, Michigan. The notice
was published in the Federal Register on July 26, 2010. (75 FR
43558). The notice was amended on July 30, 2010, November 18,
2010 and December 17, 2010 to include on-site leased workers from
Aerotek, Securitas, Knight Management, PLMSI, Acro, and Quaker
Chemical. The notices were published in the Federal Register on
August 13, 2010 (75 FR 49527), December 7, 2010 (75 FR 76038),
and January 3, 2011 (76 FR 179) respectively.
At the request of the State, the Department reviewed the
certification for workers of the subject firm. The workers are
engaged in the production of automotive transmissions and
transmission components.
The company reports that workers leased from Voith, formerly
known as Premier Manufacturing Support Services were employed on-
site at the Ypsilanti, Michigan location of General Motors
Company, formerly known as General Motors Corporation, Willow Run
Transmission Plant. The Department has determined that on-site
workers from Voith, formerly known as Premier Manufacturing
Support Services were sufficiently under the control of General
Motors Company, formerly known as General Motors Corporation,
Willow Run Transmission Plant to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Voith, formerly
known as Premier Manufacturing Services working on-site at the
Ypsilanti, Michigan location of General Motors Company, formerly
known as General Motors Corporation, Willow Run Transmission
Plant.


The amended notice applicable to TA-W-72,319 is hereby
issued as follows:
"All workers General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission
Plant, including on-site leased workers from Aerotek,
Securitas, Knight Management, PLMSI, Acro, Quaker
Chemical, and Voith, formerly known as Premier
Manufacturing Services, Ypsilanti, Michigan, who became
totally or partially separated from employment on or
after September 14, 2008, through July 7, 2012, and all
workers in the group threatened with total or partial
separation from employment on the date of certification
through two years from the date of certification, are
eligible to apply for adjustment assistance under
Chapter 2 of Title II of the Trade Act of 1974, as
amended.”

Securitas, Knight Management, PLMSI and Acro were sufficiently
under the control of General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission Plant to be
considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Securitas, Knight
Management, PLMSI and Acro working on-site at the Ypsilanti,
Michigan location of General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission Plant.


The amended notice applicable to TA-W-72,319 is hereby
issued as follows:
"All workers General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission
Plant, including on-site leased workers from Aerotek,

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on September 16, 2009 by the International Union, United
Automobile, Aerospace, and Agricultural Implement Workers of
America (UAW), on behalf of workers of General Motors Company,
formerly known as General Motors Corporation, Willow Run
Transmission Plant, Ypsilanti, Michigan. The workers are engaged
in production of automotive transmissions and transmission
components.
The investigation revealed that workers of the Willow Run
Transmission Plant who are engaged in employment related to
production of automotive transmissions and transmission
components meet the criteria for certification.
The Willow Run Transmission Plant is part of an integrated
production process supporting automotive vehicle production at
several General Motors Company facilities, including the Hamtramck
Assembly Plant, Detroit, Michigan. Workers at the Hamtramck
Assembly Plant were certified for TAA (TA-W-72,943) based on
increased aggregate imports of automobiles like or directly
competitive with the Buick Lucerne and Cadillac DTS.
Section 222(a)(1) has been met because a significant
proportion of workers have been separated over the relevant
period.
Section 222(a)(2)(A)(i) has been met because the sales and
production of automobile transmissions and transmission
components produced by the Willow Run Transmission Plant have
decreased during the relevant period.
Section 222(a)(2)(A)(ii) has been met because U.S. aggregate
imports of vehicles like or directly competitive with the Buick
Lucerne and Cadillac DTS produced by General Motors Company have
increased.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased U.S. aggregate imports contributed importantly to the
worker group separations and sales/production declines at the
Willow Run Transmission Plant.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of General Motors Company,
formerly known as General Motors Corporation, Willow Run
Transmission Plant, Ypsilanti, Michigan, who are engaged in
employment related to production of automotive transmissions and
transmission components meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:



“All workers of General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission Plant,
Ypsilanti, Michigan, who became totally or partially separated
from employment on or after September 14, 2008, through two
years from the date of certification, and all workers in the
group threatened with total or partial separation from
employment on the date of certification through two years from
the date of certification, are eligible to apply for
adjustment assistance under Chapter 2 of Title II of the Trade
Act of 1974, as amended.”

Transmission Plant to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Quaker Chemical
working on-site at the Ypsilanti, Michigan location of General
Motors Company, formerly known as General Motors Corporation,
Willow Run Transmission Plant.


The amended notice applicable to TA-W-72,319 is hereby
issued as follows:
"All workers General Motors Company, formerly known as
General Motors Corporation, Willow Run Transmission
Plant, including on-site leased workers from Aerotek,
