Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued a Certification of Eligibility to Apply for Worker Adjustment Assistance on April 30, 2010, applicable to workers of General Motors Company, formerly known as General Motors Corporation, Technical Center, including on-site leased workers from Aerotek, Bartech Group, CDI Professional Services, EDS/HP Enterprise Services, Engineering Labs, Inc., Global Technology Associates Limited, G-Tech Professional Staffing, Inc., Jefferson Wells, Kelly Services, Inc., Optimal, Inc., Populus Group, RCO Engineering, Inc., Tek Systems and Modern Engineering/Professional Services, excluding workers of the Global Purchasing and Supply Chain Division, Warren, Michigan. The Department’s notice of determination was published in the Federal Register on May 28, 2010 (75 FR 30070).
At the request of the state, the Department reviewed the certification for workers of the subject firm. The workers are engaged in the engineering and other technical support of automotive production at affiliated plants
Further review revealed that workers leased from Dialog Direct (formerly known as BUDCO) were employed on-site at the Warren, Michigan location of General Motors Company, formerly known as General Motors Corporation, Technical Center. The Department has determined that on-site workers from Dialog Direct (formerly known as BUDCO) were sufficiently under the control of General Motors Company to be considered leased workers.
The amended notice applicable to TA-W-72,121 is hereby issued as follows:
"All workers of General Motors Company, formerly known as General Motors Corporation, Technical Center, including on-site leased workers from Aerotek, Bartech Group, CDI Professional Services, EDS/HP Enterprise Services, Engineering Labs, Inc., Global Technology Associates Limited, G-Tech Professional Staffing, Inc., Jefferson Wells, Kelly Services, Inc., Optimal, Inc., Populus Group, RCO Engineering, Inc., Tek Systems,
Modern Engineering/Professional Services, General Physics Corporation, Entech, Pinnacle Technical Resources, Inc., and Dialog Direct (f/k/a BUDCO), excluding workers of the Global Purchasing and Supply Chain Division, Warren, Michigan, who became totally or partially separated from employment on or after August 14, 2008 through April 30, 2012, and all workers in the group threatened with total or partial separation from employment on the date of certification through two years from the date of certification, are eligible to apply for adjustment assistance under Chapter 2 of Title II of the Trade Act of 1974, as amended.”

amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment

Global Purchasing and Supply Chain Division, Warren, Michigan.
The notice was published in the Federal Register on May 28, 2010
(75 FR 30070). The notice was amended on December 6, 2010,
January 13, 2011, and May 20, 2011 to include on-site leased
workers from Modern Engineering/Professional Services, General
Physics Corporation, and Entech.
At the request of the state, the Department reviewed the
certification for workers of the subject firm. The workers are
engaged in the engineering and other technical support of
automotive production at affiliated plants.
Further review revealed that workers leased from Pinnacle
Technical Resources, Inc. were employed on-site at the Warren,
Michigan location of General Motors Company, formerly known as
General Motors Corporation, Technical Center. The Department has
determined that on-site workers from Pinnacle Technical
Resources, Inc. were sufficiently under the control of General
Motors Company to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Pinnacle Technical
Resources, Inc. working on-site at the Warren, Michigan location
of General Motors Company, formerly known as General Motors
Corporation, Technical Center.
The amended notice applicable to TA-W-72,121 is hereby
issued as follows:
"All workers of General Motors Company, formerly known
as General Motors Corporation, Technical Center,
including on-site leased workers from Aerotek, Bartech
Group, CDI Professional Services, EDS/HP Enterprise
Services, Engineering Labs, Inc., Global Technology

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on August 25, 2009 on behalf of workers of General Motors
Company, formerly known as General Motors Company, formerly known
as General Motors Corporation, Technical Center, Warren, Michigan.
The workers are engaged in the engineering and other technical
support of automobile production at affiliated plants.
The worker group includes on-site leased workers of Aerotek,
the Bartech Group, CDR Professional Services, EDS/HP Enterprise
Services, Engineering Labs Inc., Global Technology Associates
Limited, G-Tech Professional Staffing Inc., Jefferson Wells, Kelly
Services Inc., Optimal Inc., Populus Group, RCO Engineering Inc.,
and TEK Systems.
The worker group does not include workers General Motors
Corporation, Global Purchasing and Supply Chain Division, Warren,
Michigan who are eligible to apply for Trade Adjustment Assistance
(TAA) under TA-W-65,564, issued on April 23, 2009.
The investigation revealed that workers of the Technical
Center who are engaged in employment related to the production of
automobiles meet the criteria for certification.
The Technical Center supports automobile production at several
General Motors Company facilities, including General Motors
Company, formerly known as General Motors Corporation, Orion
Assembly Plant, Lake Orion, Michigan. Workers at the Orion
Assembly Plant were certified eligible to apply for adjustment
assistance based on increased aggregate imports of lower mid-range
cards like or directly competitive with the Chevrolet Malibu and
Pontiac G6. Workers at the Technical Center are affected by the
same factors that led to the certification of the workers engaged
in the production of automobiles at the affiliated assembly plant.
Section 222(a)(1) has been met because a significant number of
workers have been separated in the relevant period.
Section 222(a)(2)(A)(i) has been met because sales and
production by the workers’ firm have decreased during the relevant
period.
Section 222(a)(2)(A)(ii) has been met because U.S. aggregate
imports of vehicles like or directly competitive with the Chevrolet
Malibu and Pontiac G6 produced by General Motors Company have
increased.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased U.S. aggregate imports contributed importantly to the
worker group separations and sales/production declines at the
Technical Center.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of General Motors Company,
formerly known as General Motors Corporation, Technical Center,
excluding workers of the Global Purchasing and Supply Chain
Division Warren, Michigan, who are engaged in employment related to
the production of automobiles meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:


“All workers of General Motors Company, formerly known as
General Motors Corporation, Technical Center, including on-
site leased workers of Aerotek, the Bartech Group, CDR
Professional Services, EDS/HP Enterprise Services, Engineering
Labs Inc., Global Technology Associates Limited, G-Tech
Professional Staffing Inc., Jefferson Wells, Kelly Services
Inc., Optimal Inc., Populus Group, RCO Engineering Inc., and
TEK Systems, and excluding workers of the Global Purchasing
and Supply Chain Division, Warren, Michigan, who became
totally or partially separated from employment on or after
August 14, 2008, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
