Negative Determination Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Public
Agency under Section 222(b) Act, 19 U.S.C. § 2272(b), can be
satisfied if the following criteria met:
(1) a significant number or proportion of the workers in
the public agency have become totally or partially
separated, or are threatened to become totally or
partially separated;
(2) the public agency has acquired from a foreign country
services like or directly competitive with services
which are supplied by such agency; and
(3) the acquisition of services described in paragraph (2)
contributed importantly to such workers' separation or
threat of separation.

The investigation was initiated in response to a petition
filed on August 6, 2009 by the IAFF Local 266 on behalf of
workers of the City of Mansfield, Ohio, Division of Fire. The
workers provide fire suppression and emergency medical response
services. The petitioner alleges that the economic downturn
and foreign imports of steel have led to factory closings in the
city and reductions in city services.
The investigation revealed that, with regard to Section
222(b) of the Act, criterion (2) has not been met because the
public agency did not acquire services from a foreign country
like or directly competitive with the services supplied by such
agency. Criterion (3) has not been met because the worker
separations are not attributable to an acquisition of services
from a foreign country.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of the City of
Mansfield, Ohio, Division of Fire, who provide fire suppression
and emergency medical response services are denied eligibility
to apply for adjustment assistance under Section 223 of the Act,
19 U.S.C. § 2273.
