Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance on October 16, 2009, applicable to workers of Masco
Builder Cabinet Group including on-site leased workers from
Reserves Network, Jackson, Ohio. The workers produce cabinets
and cabinet frames. The notice was published in the Federal
Register on December 11, 2009 (74 FR 65797). The notice was
amended on December 22, 2010 to include other company locations.
The notice was published in the Federal Register on January 12,
2011 (76 FR 2145).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The company
reports that workers leased from Reserves Network and Reliable
Staffing were employed at the Jackson, Waverly, Seal Township,
and Seaman, Ohio locations of Masco Building Cabinet Group. The
Department has determined that these workers were sufficiently
under the control of Masco Builder Cabinet Group to be considered
leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Reserves Network and
Reliable Staffing working on-site at the Jackson, Waverly, Seal
Township and Seaman, Ohio, locations of Masco Builder Cabinet
Group.
The amended notice applicable to TA-W-71,287 is hereby
issued as follows:
"All workers of Masco Builder Cabinet Group,
including on-site leased workers from Reserves
Network and Reliable Staffing, Jackson, Ohio (TA-W-
71,287), Waverly, Ohio (TA-W-71,287A), Seal Township,
Ohio (TA-W-71,287B) and Seaman, Ohio (TA-W-71,287C)
who became totally or partially separated from
employment on or after June 11, 2008, through October
16, 2011, and all workers in the group threatened with
total or partial separation from employment on the date
of certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act
of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on June 18, 2009 on behalf of workers of Masco Builder
Cabinet Group, Jackson, Ohio (hereinafter referred as Masco). The
worker group also includes on-site leased workers from Reserves
Network. The workers produced cabinets and frames for cabinets
for the residential housing market.
The investigation revealed that workers of Masco, who are
engaged in activities related to the production of cabinets and
frames, meet the criteria for certification.
Section 222(a)(1) has been met because more than five
percent of workers at have been separated from the subject firm
during the past year.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of cabinets by Masco decreased significantly
from 2007 to 2008 and from January through June 2009 over the
corresponding 2008 period.
Section 222(a)(2)(A)(ii) has been met because company
imports of articles or directly competitive with frames for
cabinets produced by Masco have increased. Specifically, Masco
have increased imports of frames for cabinets during the relevant
period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased imports of frames for cabinets by Masco contributed
importantly to the worker group separations and production
declines at Masco.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Masco Builder Cabinet
Group including on-site leased workers from Reserves Network,
Jackson, Ohio, who are engaged in employment related to cabinets
and cabinet frames meet the worker group certification criteria
under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance
with Section 223 of the Act, 19 U.S.C. § 2273, I make the following
certification:


“All workers of Masco Builder Cabinet Group including on-
site leased workers from Reserves Network, Jackson, Ohio,
who became totally or partially separated from employment on
or after June 11, 2008, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
