Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance and Alternative Trade Adjustment on September 17th,
2009, applicable to workers of Chrysler Group, LLC, formerly
known as Chrysler, LLC, Conner Avenue Assembly Plant, Detroit,
Michigan. The notice was published in the Federal Register on
November 5, 2009 (74 FR 57337).
At the request of the State Agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of automotive components, a
substantial portion of which are shipped to an affiliated plant
where they are used in the assembly of automotive vehicles.
New information shows that workers leased from Caravan
Knight Facilities Management LLC were employed on-site at the
Detroit, Michigan location of Chrysler Group, LLC, formerly known
as Chrysler, LLC, Conner Avenue Assembly Plant. The Department
has determined that these workers were sufficiently under the
control of the subject firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Caravan Knight
Facilities Management, LLC, working on-site at the Detroit,
Michigan location of Chrysler Group, LLC, formerly known as
Chrysler, LLC, Conner Avenue Assembly Plant.
The amended notice applicable to TA-W-71,136 is hereby
issued as follows:
"All workers of Chrysler Group, LLC, formerly known as
Chrysler, LLC, Conner Avenue Assembly Plant, including
on-site leased workers from Aerotek, CDI, Syncreon and
Caravan Knight Facilities Management LLC, Detroit,
Michigan, who became totally or partially separated
from employment on or after May 27, 2008, through
September 17, 2011, are eligible to apply for
alternative trade adjustment assistance under Section
246 of Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor herein
presents the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The group eligibility requirements for workers of a Firm under
Section 222(a) of the Act, 19 U.S.C. § 2272(a), are satisfied if
the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.
The investigation was initiated in response to a petition
filed on June 10, 2009 by the International Union, United
Automobile, Aerospace, and Agricultural Implement Workers of
America (UAW), Local 212, on behalf of workers of Chrysler Group
LLC, formerly known as Chrysler LLC, Conner Avenue Assembly Plant,
Detroit, Michigan. The workers produce the Dodge Viper sports car.
Production of the Dodge Viper at the Conner Avenue Assembly
Plant includes both the manufacture of V-10 engines and the
assembly of the vehicle. The majority of the V-10 engines produced
at the Conner Avenue Assembly Plant are used as a component in
the assembly of the Dodge Viper; a small number are sold to
external customers.
The investigation revealed that the worker group includes
on-site leased workers from Aerotek, CDI, and Syncreon.
The investigation revealed that workers of the Conner Avenue
Assembly Plant who are engaged in employment related to the
production of automobiles meet the criteria for certification.
Section 222(a)(1) has been met because a significant portion
of workers has been separated in the last year.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of automobiles by the Conner Avenue Assembly
Plant declined in January through July 2009 compared with the
same period in 2008.
Section 222(a)(2)(A)(ii) has been met because aggregate
imports of articles like or directly competitive with the
automobiles produced at the Conner Avenue Assembly Plant have
increased. Specifically, U.S. imports of premium sporty cars
increased relative to Dodge Viper sales in January through July
2009 compared with the same period in 2008. Sales of the Dodge
Viper represented a smaller share of the total U.S. market
compared with imported similar vehicles in the above periods.
Finally, Section 222(a)(2)(A)(iii) has been met because the
increased U.S. aggregate imports of premium sporty cars
contributed importantly to the worker group separations and
sales/production declines at the Conner Avenue Assembly Plant.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Chrysler Group LLC,
formerly known as Chrysler LLC, Conner Avenue Assembly Plant,
Detroit, Michigan, who are engaged in employment related to the
assembly of automobiles meet the worker group certification
criteria under Section 222(a) of the Act, 19 U.S.C. § 2272(a). In
accordance with Section 223 of the Act, 19 U.S.C. § 2273, I make
the following certification:
“All workers of Chrysler Group LLC, formerly known as Chrysler
LLC, Conner Avenue Assembly Plant, including on-site leased
workers from Aerotek, CDI, and Syncreon, Detroit, Michigan,
who became totally or partially separated from employment on
or after May 27, 2008, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on date of
certification through two years from the date of
certification, are eligible to apply for adjustment assistance
under Chapter 2 of Title II of the Trade Act of 1974, as
amended.”
