Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to apply for Worker
Adjustment Assistance on October 19, 2009, applicable to workers
of The Boeing Company, Commercial Aircraft Group, Puget Sound,
Washington, (TA-W-70,520), and The Boeing Company, Commercial
Aircraft Group, Portland, Oregon (TA-W-70,520A). The notice was
published in the Federal Register on December 11, 2009 (74 FR
65794-65795). The notice was amended on January 8, 2010 and
March 26, 2010 to include on-site leased workers. The notices
were published in the Federal Register on January 20, 2010 (75
FR 3250-3251) and on April 19, 2010 (75 FR 20385-20386),
respectively. The workers are engaged in activities related to
the production of large commercial aircraft.
The company reports that on-site leased workers from PSC
Industrial Services, Inc. were employed on-site at both the
Puget Sound, Washington and Portland, Oregon locations of The
Boeing Company, Commercial Aircraft Group. The Department has
determined that these workers were sufficiently under the
control of the subject firm to be considered leased workers.
Based on these findings, the Department is amending the
certification to include leased workers from PSC Industrial
Services, Inc. working on-site at the Puget Sound, Washington
and Portland, Oregon locations of The Boeing Company, Commercial
Aircraft Group.


The amended notice applicable to the TA-W-70,520 and TA-W
70,520A are hereby issued as follows:
“All workers of The Boeing Company, Commercial Aircraft
Group, including on-site leased workers from Comforce
Corporation, Adecco, Multax, Inconen, CTS, Hi-Tec, Woods,
Ciber, Kelly Services, Analysts International Corp, Comsys,
Filter LLC, Excell, Entegee, Chipton-Ross, Ian Martin, Can-
Tech, IT Services, IDEX Solutions (NW CAD), Media Logic, HL
YOH, Volt, PDS, CDI Corp, Teksystems, Innovative Systems,

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on May 26, 2009 by the International Association of
Machinists and Aerospace Workers, Local 751, on behalf of
workers of The Boeing Company, Commercial Aircraft Group,
employed at various locations in Puget Sound, Washington (TA-W-
70,520) and in Portland, Oregon (TA-W-70,520A). The workers
employed in the Puget Sound area of Washington and in Portland,
Oregon are engaged in activities related to the production of
large commercial aircraft.
Specific commercial aircraft manufactured and sold by
Boeing are the 737, 747, 767, 777, and, beginning in 2010, the
787. The 737 is assembled both at Renton and Everett,
Washington; the others are assembled in Everett. The assembly of
aircraft in both Everett and Renton involves both the
subassembly of large sections of the aircraft (such as the wing
or tail section) and the final assembly of the aircraft. Workers
of other facilities included in the Puget Sound worker group,
and at the Portland location, are engaged in engineering,
design, subassembly, testing and other tasks supporting the
production of finished aircraft in Renton and Everett.
The investigation revealed that workers of the Commercial
Aircraft Group, Puget Sound, Washington and Portland, Oregon,
who are engaged in employment related to the production of large
commercial aircraft, meet the criteria for certification.
Section 222(a)(1) has been met because extensive worker
separations have occurred both at facilities in the Puget
Sound area and Portland.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of the Boeing 737 commercial aircraft by the
Commercial Aircraft Group decreased in January through August
2009 compared with the same period in 2008. In addition, with
respect to the 747, 767, 777, and 787, the subject firm has
reduced the domestic portion of production of aircraft
components and subassemblies in January through August, 2009
compared with the same period in 2008.
Section 222(a)(2)(A)(ii) has been met because aggregate
imports of articles like or directly competitive with large
commercial aircraft produced by the Commercial Aircraft Group
have increased. Specifically, United States imports of the
single aisle, narrow body aircraft like or directly
competitive with the Boeing 737 increased relative to Boeing
737 sales in 2008 compared with 2007 and in January through
August 2009 compared with the same period in 2008. Sales of
the Boeing 737s represented a smaller share of the total U.S.
market compared with imported similar aircraft in the above
periods. In addition, with respect to the 747, 767, 777, and
787, subject firm imports of aircraft components and
subassemblies increased in January through August, 2009
compared with the same period in 2008.
Finally, Section 222(a)(2)(A)(iii) has been met because
the increased United States aggregate imports of single aisle,
narrow body aircraft contributed importantly to the worker
group separations and sales/production declines in the
Commercial Aircraft Group assembling Boeing 737 aircraft, and
the acquisition by The Boeing Company of large commercial
aircraft components and subassemblies like or directly
competitive with those produced for the larger aircraft (the
747, 767, 777, and 787) manufactured by the workers’ of the
Commercial Aircraft Group contributed importantly to the
worker group separations and sales/production declines of
those producing such aircraft and related components and
subassemblies.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of The Boeing Company,
Commercial Aircraft Group, Puget Sound, Washington and Portland,
Oregon, who are engaged in employment related to the production
of large commercial aircraft, meet the worker group
certification criteria under Section 222(a) of the Act, 19
U.S.C. § 2272(a). In accordance with Section 223 of the Act, 19
U.S.C. § 2273, I make the following certification:
“All workers of The Boeing Company, Commercial Aircraft
Group, Puget Sound, Washington and Portland, Oregon, who
became totally or partially separated from employment on or
after May 22, 2008, through two years from the date of
certification, and all workers in the group threatened with
total or partial separation from employment on the date of
certification through two years from the date of
certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
