Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
issued a Certification of Eligibility to Apply for Worker
Adjustment Assistance on December 8, 2009, applicable to workers
of Delphi Packard Electrical/Electronic Architecture, a
subsidiary of Delphi Corporation, including on-site leased
workers from Bartech, Warren, Ohio. The notice was published in
the Federal Register on January 25, 2010 (75 FR 3930). The
notice was amended on January 28, 2010 to include on-site leased
workers from EDS an HP Company. The notice was published in the
Federal Register on April 1, 2010 (75 FR 16513)
At the request of the State Agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of wiring and connector
components.
The review shows that on November 3, 2006, a certification
of eligibility to apply for adjustment assistance was issued for
all workers of Delphi Packard Electric, Warren, Ohio, separated
from employment on or after July 26, 2005 through November 3,
2008. The notice was published in the Federal Register on
November 22, 2006 (71 FR 67649).
In order to avoid an overlap in worker group coverage, the
Department is amending the May 19, 2008 impact date established
for TA-W-70,324, to read November 4, 2008.
The amended notice applicable to TA-W-70,324 is hereby
issued as follows:
“All workers of Delphi Packard Electrical/Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech and EDS an HP Company,
Warren, Ohio (TA-W-70,324, Delphi Packard
Electrical/Electronic Architecture, a subsidiary of Delphi
Corporation, including on-site leased workers from Bartech,
and EDS an HP Company, Rootstown, Ohio (TA-W-70,324A),
Delphi Packard Electrical/Electronic Architecture, a
subsidiary of Delphi Corporation, including on-site leased
workers from Bartech and EDS an HP Company, Vienna, Ohio
(TA-W-70,324B), Delphi Packard Electrical/ Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech and EDS an HP Company,
Howland, Ohio (TA-W-70,324C), Delphi Packard
Electrical/Electronic Architecture, a subsidiary of Delphi
Corporation, including on-site leased workers from Bartech,
and EDS an HP Company, Cortland, Ohio (TA-W-70,324D), who
became totally or partially separated from employment on or
after November 4, 2008, through December 8, 2011, and all
workers in the group threatened with total or partial
separation from employment on date of certification through
two years from the date of certification, are eligible to
apply for adjustment assistance under Chapter 2 of Title II
of the Trade Act of 1974, as amended.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers’ firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers’ separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on May 20, 2009, by the International Union of Electronic,
Electrical, Salaried, Machine and Furniture Workers –
Communication Workers of America, Local 717, on behalf of
workers of Delphi Packard Electrical/Electronic Architecture, a
subsidiary of Delphi Corporation, Warren, Ohio (TA-W-70,324),
Rootstown, Ohio (TA-W-70,324A), Vienna, Ohio (TA-W-70,324B),
Howland, Ohio (TA-W-70,324C), and Cortland, Ohio (TA-W-70,324D)
(Delphi Packard Electric Ohio Operations). The workers produce
wiring and connector components.
The petitioner requested that workers of Delphi Packard
Electrical/Electronic Architecture, a subsidiary of Delphi
Corporation, Bazetta Township, Ohio be included in the
petition. However, the investigation revealed that the
facility closed in 2007, which is outside the relevant period
of the investigation. Consequently, the Bazetta Township,
Ohio facility is not included in the Department’s
determination.
The worker group includes on-site leased workers from
Bartech who worked at all locations.
The Department also received a separate petition (TA-W-
70,421) filed on behalf of workers of Delphi Automotive
Systems, E&R Building, Warren, Ohio. A company official
confirmed that petition number TA-W-70,324 encompasses those
workers. As such, the investigation of TA-W-70,421 was
terminated on November 23, 2009.
The investigation revealed that workers of Delphi Packard
Electric Ohio Operations who are engaged in employment related
to the production of wiring and connector components meet the
criteria for certification.
Section 222(a)(1) has been met because a significant
number of workers were separated from employment during the
relevant period.
Section 222(a)(2)(A)(i) has been met because the sales
and production of wiring and connector components by Delphi
Packard Electric Ohio Operations have decreased absolutely
during the relevant period.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with wiring and
connector components produced by Delphi Packard Electric Ohio
Operations have increased. The Department surveyed Delphi
Packard Electric Ohio Operations’ major declining customers
regarding purchases of wiring and connector components in 2007,
2008, and during January through April 2009 compared to the
corresponding 2008 period. The surveys revealed an increased
reliance on imports during the relevant period.
Finally, Section 222(a)(2)(A)(iii) has been met because
increased reliance on imports of wiring and connector
components by customers of Delphi Packard Electric Ohio
Operations contributed importantly to the worker group
separations at the Warren, Ohio (TA-W-70,324), Rootstown, Ohio
(TA-W-70,324A), Vienna, Ohio (TA-W-70,324B), Howland, Ohio (TA-
W-70,324C), and Cortland, Ohio (TA-W-70,324D) facilities.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Delphi Packard
Electrical/Electronic Architecture, a subsidiary of Delphi
Corporation, Warren, Ohio (TA-W-70,324), Rootstown, Ohio (TA-W-
70,324A), Vienna, Ohio (TA-W-70,324B), Howland, Ohio (TA-W-
70,324C), and Cortland, Ohio (TA-W-70,324D), who are engaged in
employment related to production of wiring and connector
components meet the worker group certification criteria under
Section 222(a) of the Act, 19 U.S.C. § 2272(a). In accordance
with Section 223 of the Act, 19 U.S.C. § 2273, I make the
following certification:
“All workers of Delphi Packard Electrical/Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech, Warren, Ohio (TA-W-
70,324), Delphi Packard Electrical/Electronic Architecture,
a subsidiary of Delphi Corporation, including on-site
leased workers from Bartech, Rootstown, Ohio (TA-W-
70,324A), Delphi Packard Electrical/Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech, Vienna, Ohio (TA-W-
70,324B), Delphi Packard Electrical/Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech, Howland, Ohio (TA-W-
70,324C), Delphi Packard Electrical/Electronic
Architecture, a subsidiary of Delphi Corporation, including
on-site leased workers from Bartech, Cortland, Ohio (TA-W-
70,324D), who became totally or partially separated from
employment on or after May 19, 2008, through two years from
the date of certification, and all workers in the group
threatened with total or partial separation from employment
on the date of certification through two years from the
date of certification, are eligible to apply for adjustment
assistance under Chapter 2 of Title II of the Trade Act of
1974, as amended.”
