Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended ("Act"), 19 U.S.C. § 2273, the Department of Labor
herein presents the results of an investigation regarding
certification of eligibility to apply for worker adjustment
assistance.
The group eligibility requirements for workers of a Firm
under Section 222(a) of the Act, 19 U.S.C. § 2272(a), are
satisfied if the following criteria are met:
(1) a significant number or proportion of the workers in such
workers' firm have become totally or partially separated, or
are threatened to become totally or partially separated; and

(2)(A)(i) the sales or production, or both, of such firm have
decreased absolutely; and

(ii)(I) imports of articles or services like or directly
competitive with articles produced or services supplied by
such firm have increased; and

(iii) the increase in imports described in clause (ii)
contributed importantly to such workers' separation or
threat of separation and to the decline in the sales or
production of such firm.

The investigation was initiated in response to a petition
filed on May 18, 2009 by the United Steel Workers, Local 7686,
on behalf of workers of Noranda Aluminum, Incorporated,
Maintenance Department, a subsidiary of Noranda Aluminum
Holding Corporation, New Madrid, Missouri (TA-W-70,037);
Noranda Aluminum, Incorporated, Green Carbon Department, a
subsidiary of Noranda Aluminum Holding Corporation, New
Madrid, Missouri (TA-W-70,037A); Noranda Aluminum,
Incorporated, Carbon Rodding Department, a subsidiary of
Noranda Aluminum Holding Corporation, New Madrid, Missouri
(TA-W-70,037B); Noranda Aluminum, Incorporated, Carbon Bake
Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-70,037C); Noranda
Aluminum, Incorporated, Air Control Department, a subsidiary
of Noranda Aluminum Holding Corporation, New Madrid, Missouri
(TA-W-70,0037D); Noranda Aluminum, Incorporated, River
Unloading Department, a subsidiary of Noranda Aluminum Holding

Corporation, New Madrid, Missouri (TA-W-70,037I). The workers
are engaged in activities related to the production of primary
aluminum products. All of the prior stated firms together will
be referred to as "Noranda".
The investigation revealed that two departments of
Noranda were certified for Trade Adjustment Assistance on
April 16, 2009: (1) Noranda Aluminum, Incorporated, Metal
Products Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-65,344, expires on
April 16, 2011) and (2) Noranda Aluminum, Incorporated, Rod
Mill Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-65,344A, expires on
April 16, 2011).
The investigation also revealed that workers of Noranda who
are engaged in activities related to the production of primary
aluminum meet the criteria for certification.
Section 222(a)(1) has been met because a significant
number or proportion of workers have become separated at
Noranda.
Section 222(a)(2)(A)(i) has been met because the sales
and/or production of primary aluminum by Noranda have
decreased during the relevant period.
Section 222(a)(2)(A)(ii) has been met because imports of
articles like or directly competitive with primary aluminum
produced by Noranda have increased during the relevant period.
Finally, Section 222(a)(2)(A)(iii) has been met because
the increased imports of primary aluminum by customers of
Noranda contributed importantly to the worker group
separations and sales/production declines at Noranda.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of Noranda Aluminum,
Incorporated, Maintenance Department, a subsidiary of Noranda
Aluminum Holding Corporation, New Madrid, Missouri (TA-W-
70,037), Noranda Aluminum, Incorporated, Green Carbon
Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-70,037A), Noranda
Aluminum, Incorporated, Carbon Rodding Department, a
subsidiary of Noranda Aluminum Holding Corporation, New
Madrid, Missouri (TA-W-70,037B), Noranda Aluminum,
Incorporated, Carbon Bake Department, a subsidiary of Noranda
Aluminum Holding Corporation, New Madrid, Missouri (TA-W-
70,037C), Noranda Aluminum, Incorporated, Air Control
Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-70,037D), Noranda
Aluminum, Incorporated, River Unloading Department, a
subsidiary of Noranda Aluminum Holding Corporation, New
Madrid, Missouri (TA-W-70,037E), Noranda Aluminum,
Incorporated, 136 Area Department, a subsidiary of Noranda
Aluminum Holding Corporation, New Madrid, Missouri (TA-W-
70,037F), Noranda Aluminum, Incorporated, Pot Lines I, II, III
Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-70,037G), Noranda
Aluminum, Incorporated, Pot Services Department, a subsidiary
of Noranda Aluminum Holding Corporation, New Madrid, Missouri
(TA-W-70,037H), and Noranda Aluminum, Incorporated, Technical
Services Department, a subsidiary of Noranda Aluminum Holding
Corporation, New Madrid, Missouri (TA-W-70,037I), who are
engaged in employment related to primary aluminum meet the
worker group certification criteria under Section 222(a) of the
Act, 19 U.S.C. § 2272(a). In accordance with Section 223 of the
Act, 19 U.S.C. § 2273, I make the following certification:


"All workers of Noranda Aluminum, Incorporated,
Maintenance Department, a subsidiary of Noranda Alumunium
Holding Corporation, New Madrid, Missouri (Maintenance);
Noranda Aluminum, Incorporated, Green Carbon Department,
a subsidiary of Noranda Aluminum Holding Corporation, New
Madrid, Missouri (Green Carbon); Noranda Aluminum,
Incorporated, Carbon Rodding Department, a subsidiary of
Noranda Alumunium Holding Corporation, New Madrid,
Missouri (Carbon Rodding); Noranda Aluminum,
Incorporated, Carbon Bake Department, a subsidiary of

for adjustment assistance under Chapter 2 of Title II of
the Trade Act of 1974, as amended."
