Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on April 27, 2009,
applicable to workers of Chrysler, LLC, Sterling Heights Assembly
Plant, Sterling Heights, Michigan. The notice was published in
the Federal Register on May 18, 2009 (74 FR 23214). The notice
was amended on June 29, 2009 to include on-site leased workers of
Caravan Knight Facilities Management LLC. The notice was
published in the Federal Register on July 14, 2009
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
assembled the Chrysler Sebring, Chrysler Sebring Convertible and
the Dodge Avenger
New information shows that workers leased from Resource
Technologies were employed on-site at the Sterling, Michigan
location of Chrysler, LLC, Sterling Heights Plant. The
Department has determined that these workers were sufficiently
under the control of the subject firm to be considered leased
workers.
Based on these findings, the Department is amending this
certification to include workers leased from Resource
Technologies working on-site at the Sterling, Michigan location
of Chrysler, LLC, Sterling Heights Plant.


The amended notice applicable to TA-W-65,762 is hereby
issued as follows:
"All workers of Chrysler, LLC, Sterling Heights Plant,
including on-site leased workers from Caravan Knight
Facilities Management LLC and Resource Technologies,
Sterling, Michigan, who became totally or partially
separated from employment on or after March 8, 2008,
through April 27, 2011, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on April 7, 2009, in response
to a petition filed on behalf of workers of Chrysler LLC, Sterling
Heights Assembly Plant, Sterling Heights, Michigan. The workers
assemble the Chrysler Sebring, Chrysler Sebring Convertible and
Dodge Avenger. Workers are not separately identifiable by specific
vehicle.
The investigation revealed that employment and sales declined
in 2008 compared with 2007 and in January through March 2009
compared with the same period in 2008.
The Department of Labor conducted an analysis of the United
States market share of vehicles like or directly competitive with
the vehicles assembled in Sterling Heights. The Chrysler Sebring
and Dodge Avenger are lower mid-range cars. The investigation
determined that imports of such vehicles increased their share of
the U.S. market from 2007 to 2008, and in January through March
2009 compared with the same period in 2008, while the subject
vehicles decreased their share of the U.S. market. Sales of other
domestically manufactured vehicles in the same category declined as
well.
Although aggregate U.S. sales of imported like or directly
competitive vehicles declined in 2008 and in January through March
2009, sales of like vehicles produced at the subject firm
experienced much greater declines, showing an increased consumer
reliance on vehicles produced abroad.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
Conclusion
After careful review of the facts obtained in the investigation,
I determine that increases of imports of articles like or directly
competitive with the vehicles produced at the subject plant
contributed importantly to the total or partial separation of workers
and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make the
following certification:
"All workers of Chrysler LLC, Sterling Heights Assembly Plant,
Sterling Heights, Michigan, who become totally or partially
separated from employment on or after March 8, 2008 through
two years from the date of certification are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”
