Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on June 25, 2009,
applicable to workers of Chrysler, LLC, Sterling Heights Vehicle
Test Center, Sterling Heights, Michigan. The notice was
published in the Federal Register on July 14, 2009 (74 FR 34038).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in vehicle testing and other activities related to
the production of automobiles.
New information shows that workers leased from Caravan
Knight Facilities Management LLC were employed on-site at the
Sterling Heights, Michigan location of Chrysler, LLC, Sterling
Heights Vehicle Test Center. The Department has determined that
these workers were sufficiently under the control of the subject
firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Caravan Knight
Facilities Management LLC working on-site at the Sterling
Heights, Michigan location of Chrysler, LLC, Sterling Heights
Vehicle Test Center.
The amended notice applicable to TA-W-65,672 is hereby
issued as follows:
"All workers of Chrysler, LLC, Sterling Heights Vehicle
Test Center, including on-site leased workers from
Caravan Knight Facilities Management LLC, Sterling
Heights, Michigan, who became totally or partially
separated from employment on or after March 6, 2008,
through June 25, 2011, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on March 25, 2009, in response
to a petition filed by the United Auto Workers, Local 140, on
behalf of workers of Chrysler LLC, Sterling Heights Vehicle Test
Center, Sterling Heights, Michigan. The workers were engaged in
vehicle testing and other activities related to the production of
automobiles.
The investigation revealed that all workers of the Sterling
Heights Vehicle Test Center were laid off on March 10, 2008 when
the facility shut down.
The investigation further revealed that the subject workers
supported production at Chrysler’s manufacturing affiliates,
including Chrysler LLC, St. Louis North Assembly Plant, Fenton,
Missouri. Workers at that facility were certified eligible to apply
for adjustment assistance on April 14, 2008 based on increased
aggregate imports of vehicles like or directly competitive with the
Dodge Ram (TA-W-63,052).
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with automobiles produced by the
subject firm or subdivision contributed importantly to the total or
partial separation of workers and to the decline in sales or
production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of Chrysler LLC, Sterling Heights Vehicle Test
Center, Sterling Heights, Michigan, who become totally or
partially separated from employment on or after March 6, 2008
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
