Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on March 19, 2009,
applicable to workers of Navistar, Inc., Engine Group,
Indianapolis Engine Plant, including on-site leased workers of
Community Hospital, Nishida and Securitas, Indianapolis Casting
Corp., a wholly owned subsidiary of Navistar, Inc., including on-
site leased workers from Community Hospital, Nishida and
Securitas and Navistar, Inc., Engine Group, Advanced
Manufacturing Engineering, including on-site leased workers from
Community Hospital, Nishida and Securitas, Indianapolis, Indiana.
The notice was published in the Federal Register on April 7, 2009
(74 FR 15757).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in activities related to diesel engine production.
New information shows that workers leased from Populus Group
were employed on-site at the above mentioned Indianapolis,
Indiana locations of Navistar, Inc., Engine Group, Indianapolis
Engine Plant, Indianapolis Casting Corporation, a wholly owned
subsidiary of Navistar, Inc. and Navistar, Inc., Engine Group,
Advance Manufacturing Engineering. The Department has determined
that these workers were sufficiently under the control of the
subject firm to be considered leased workers.
The intent of the Department’s certification is to include
all workers of the subject firm secondarily affected as a
supplier of diesel engines to a trade certified firm.
Based on these findings, the Department is amending this
certification to include workers leased from Populus Group
working on-site at the Indianapolis, Indiana locations.
The amended notice applicable to TA-W-65,437 & A & B is
hereby issued as follows:


"All workers of Navistar, Inc., Engine Group,
Indianapolis Engine Plant, including on-site leased
workers from Community Hospital, Nishida, Securitas and
Populus Group, Indianapolis, Indiana (TA-W-65,437),
Indianapolis Casting Corporation, a wholly owned
subsidiary of Navistar, Inc., including on-site leased
workers of Community Hospital, Nishida, Securitas and
Populus Group, Indianapolis, Indiana (TA-W-65,437A),
and Navistar, Inc., Engine Group, Advanced
Manufacturing Engineering, including on-site leased
workers of Community Hospital, Nishida, Securitas and
Populus Group, Indianapolis, Indiana (TA-W-65,437B),
who became totally or partially separated from
employment on or after February 26, 2008, through March
19, 2011, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974,
and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade
Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance as a secondarily affected
worker group.
In order to make an affirmative determination and issue a
certification of eligibility for secondary workers to apply for
Trade Adjustment Assistance, the group eligibility requirements of
paragraph (b) of Section 222 of the Trade Act, as amended, must be
met. It is determined in this case that the requirements of (b) of
Section 222, as amended, have been met.
The investigation was initiated on March 2, 2009 in response
to a petition filed by the International Union, United Automobile,
Aerospace, and Agricultural Implement Workers of America, Locals
98, 226 and 2274, on behalf of workers of Navistar, Inc., Engine
Group, Indianapolis Engine Plant, Indianapolis, Indiana (TA-W-
65,437); Indianapolis Casting Corporation, a wholly owned
subsidiary of Navistar, Inc., Indianapolis, Indiana (TA-W-65,437A);
and Navistar, Inc., Engine Group, Advanced Manufacturing
Engineering, Indianapolis, Indiana (TA-W-65,437B). The workers are
engaged in activities related to the production of diesel engines.
The three worker groups all include on-site workers from
Community Hospital, Nishida, and Securitas.
The workers of the Indianapolis Engine Plant produce diesel
engines. The workers of the Indianapolis Casting Corporation
produce the grey iron head and block castings from which the
engines are made. The workers of Advanced Manufacturing Engineering
provide engineering support for the diesel engine and grey iron
head and block castings production. Workers are separately
identifiable by task, but are not separately identifiable by final
article produced.
Separations are threatened at each of the three Indianapolis
facilities.
The investigation also revealed that the Indianapolis Engine
Plant supplied a component part utilized in the production of
automobiles, and at least 20 percent of its sales are supplied to a
manufacturer whose workers were certified eligible to apply for
adjustment assistance. The Indianapolis Casting Corporation is part
of an integrated production process, supplying grey iron head and
block head castings used as components in the production of diesel
engines at the Indianapolis Engine Plant. Workers at the
Indianapolis Casting Corporation are affected by the same factors
as the workers of the Indianapolis Engine Plant. The workers of
Advanced Manufacturing Engineering support production at both the
Indianapolis Engine Plant and at the Indianapolis Casting
Corporation.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that workers of the subject firm qualify
as adversely affected secondary workers under Section 222 of the
Trade Act of 1974, as amended. In accordance with the provisions of
the Act, I make the following certification:



“All workers of Navistar, Inc., Engine Group, Indianapolis
Engine Plant, including on-site leased workers of Community
Hospital, Nishida and Securitas, Indianapolis, Indiana (TA-W-
65,437); Indianapolis Casting Corporation, a wholly owned
subsidiary of Navistar, Inc., including on-site leased workers
of Community Hospital, Nishida and Securitas, Indianapolis,
Indiana (TA-W-65,437A); and Navistar, Inc., Engine Group,
Advanced Manufacturing Engineering, including on-site leased
workers of Community Hospital, Nishida and Securitas,
Indianapolis, Indiana (TA-W-65,437B), who became totally or
partially separated from employment on or after February 26,
2008, through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
