Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on January 27, 2009,
applicable to workers of Maitland-Smith Furniture Industries,
Incorporated, a subsidiary of HDM Furniture Industries,
Incorporated, High Point, North Carolina. The notice was
published in the Federal Register on February 23, 2009 (74 FR
8115).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
perform warehousing, distribution and various support service
functions related to the production of household furniture.


New information shows that Furniture Brands International,
Incorporated is the parent firm of Maitland-Smith Furniture
Industries, Incorporated, a subsidiary of HDM Furniture
Industries, Industries, Incorporated. Workers wages at the
subject firm are being reported under the Unemployment Insurance
(UI) tax account for Furniture Brands International,
Incorporated.
Accordingly, the Department is amending this certification
to properly reflect this matter.
The intent of the Department’s certification is to include
all workers of Maitland-Smith Furniture Industries, Incorporated,
a subsidiary of HDM Furniture Industries, Incorporated, a
subsidiary of Furniture Brands International, Incorporated, High
Point, North Carolina, who were adversely affected by increased
company imports.


The amended notice applicable to TA-W-64,776 is hereby
issued as follows:
"All workers of Maitland-Smith Furniture Industries,
Incorporated, a subsidiary of HDM Furniture Industries,
Incorporated, a subsidiary of Furniture Brands
International, Incorporated, High Point, North
Carolina, who became totally or partially separated
from employment on or after December 23, 2007 through
January 27, 2011, are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974,
and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade
Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on December 24, 2008 in
response to a petition filed by a company official on behalf of
workers of Midland-Smith Furniture Industries, Inc., a subsidiary
of HDM Furniture Industries Inc., High Point, North, Carolina. The
workers perform warehousing, distribution and various support
service functions related to household furniture.

The investigation revealed that employment at the subject firm
declined from December 23, 2007 to December 23, 2008.
The investigation further revealed that the decline in
employment at the subject firm is in part related to increased
imports of household furniture like or directly competitive with
that which is produced by HDM Furniture Industries Inc.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with household furniture produced by
HDM Furniture Industries Inc., contributed importantly to the total
or partial separation of workers and to the decline in sales or
production at that firm or subdivision.
In accordance with the provisions of the Act, I make the
following certification:
"All workers of Midland-Smith Furniture Industries, Inc., a
subsidiary of HDM Furniture Industries Inc., High Point,
North, Carolina, who became totally or partially separated
from employment on or after December 23, 2007 through two
years from the date of certification, are eligible to apply
for adjustment assistance under Section 223 of the Trade Act
of 1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974."
