Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (“Act”), 19 U.S.C. § 2273, the Department of Labor issued
a Certification of Eligibility to Apply for Worker Adjustment
Assistance and Alternative Trade Adjustment on December 19th,
2008, applicable to workers of Chrysler Transportation, LLC, a
subsidiary of Chrysler, LLC, Detroit, Michigan. The notice was
published in the Federal Register on January 14, 2009 (74 FR
2136).
At the request of the State Agency, the Department reviewed
the certification for workers of the subject firm. The workers
provide transport of parts from suppliers to Chrysler
manufacturing facilities, a substantial portion of which are
shipped to an affiliated plant where they are used in the
assembly of automotive vehicles.
New information shows that workers leased from Caravan
Knight Facilities Management LLC were employed on-site at the
Detroit, Michigan location of Chrysler Transportation, LLC, a
subsidiary of Chrysler, LLC. The Department has determined that
these workers were sufficiently under the control of the subject
firm to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Caravan Knight
Facilities Management, LLC, working on-site at the Detroit,
Michigan location of Chrysler Transportation, LLC, a subsidiary
of Chrysler, LLC.
The amended notice applicable to TA-W-64,684 is hereby
issued as follows:
"All workers of Chrysler Transportation, LLC, a
subsidiary of Chrysler, LLC, including on-site leased
workers from Caravan Knight Facilities Management LLC,
Detroit, Michigan, who became totally or partially
separated from employment on or after December 12,
2007, through December 19, 2010, are eligible to apply
for alternative trade adjustment assistance under
Section 246 of Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on December 15, 2008, in
response to a petition filed by the United Automobile, Aerospace,
and Agricultural Implement Workers of America International Union
on behalf of workers of Chrysler Transportation LLC, a subsidiary
of Chrysler LLC, Detroit, Michigan. The workers provide transport
of parts from suppliers to Chrysler manufacturing facilities.
The investigation revealed that workers of Chrysler
Transportation LLC, a subsidiary of Chrysler LLC, Detroit,
Michigan, were direct support of production of Chrysler LLC, St.
Louis North Assembly Plant, Fenton, Missouri, whose workers were
certified eligible to apply for adjustment assistance (TA-W-
63,052), based on increased imports of like or directly competitive
vehicles.
The investigation determined that the decline in employees of
Chrysler Transportation LLC, a subsidiary of Chrysler LLC, Detroit,
is related to the increase in U.S. imports of vehicles like or
directly competitive with those produced by Chrysler LLC.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with vehicles produced at Chrysler
LLC, contributed importantly to the total or partial separation of
workers and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make
the following certification:
"All workers of Chrysler Transportation LLC, a subsidiary of
Chrysler LLC, Detroit, Michigan, who became totally or
partially separated from employment on or after December 12,
2007, through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
