Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974
(19 USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on April 21, 2009,
applicable to workers of North American Lighting, Inc., Salem, IL
Plant, Salem, Illinois including on-site leased workers from
Westaff, Manpower, and Select. The notice was published in the
Federal Register on May 7, 2009 (74 FR 21406).
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers are engaged in the production of exterior automotive
lighting – signal lighting.
The company reports that it incorrectly identified Select as
one of the three leasing agencies with workers working on-site at
the Salem, Illinois location of North American Lighting, Salem IL
Plant. Salem Business Center is the third leasing agency, not
Select. Accordingly, the Department is amending the
certification to remove Select as the leasing agency and
replacing it with workers from Salem Business Center working on-
site at the Salem, Illinois location of the subject firm.
The amended notice applicable to TA-W-64,526A is hereby
issued as follows:
"All workers of North American Lighting, Salem, IL Plant,
Salem, Illinois, including on-site leased workers from
Westaff, Manpower, and Salem Business Center, who became
totally or partially separated from employment on or after
November 21, 2007 through April 21, 2011, are eligible to
apply for adjustment assistance under Section 223 of the
Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246
of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on November 24, 2008 in
response to a petition filed by a state agency representative on
behalf of workers of North American Lighting, Inc., Paris, IL
Plant, Paris, Illinois producing exterior automotive lighting -
advanced forward lighting (TA-W-64,526); North American Lighting,
Inc., Salem, IL Plant, Salem, Illinois producing exterior
automotive lighting - signal lighting (TA-W-64,526A); North
American Lighting, Inc., Flora, IL Plant, Flora, Illinois producing
exterior automotive lighting - forward lighting (TA-W-64,526B); and
North American Lighting, Inc., Corporate Headquarters, Paris,
Illinois engaged in administrative activities in support of
manufacturing within the corporation (TA-W-64,526C).
North American Lighting, Inc., Paris, IL Plant, Paris,
Illinois (TA-W-64,526) also utilized leased/temporary workers from
Manpower, Select, and Trillium.
North American Lighting, Inc., Salem, IL Plant, Salem,
Illinois (TA-W-64,526A) also utilized leased/temporary workers from
Westaff, Manpower, and Select.
North American Lighting, Inc., Flora, IL Plant, Flora,
Illinois (TA-W-64,526B) also utilized leased/temporary workers from
Westaff.

The investigation revealed a significant number or proportion
of workers at the subject firms have been separated with declining
production comparing January through November 2008 to the same
period in 2007.
The Department of Labor surveyed the subject firm’s major
declining customers regarding purchases of exterior automotive
lighting (forward, signal, and advanced forward lighting) and like
or directly competitive articles for 2006, 2007, January through
November 2007, and January through November 2008. The survey
revealed an increased reliance on imports of exterior automotive
lighting.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers of the firm are age 50 or over
and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with exterior automotive lighting
products produced by North American Lighting, Inc., contributed
importantly to the total or partial separation of workers and to
the decline in sales or production at that firm or subdivision. In
accordance with the provisions of the Act, I make the following
certification:











"All workers of North American Lighting, Inc., Paris, IL
Plant, Paris, Illinois including on-site leased workers from
Manpower, Select, and Trillium (TA-W-64,526); North American
Lighting, Inc., Salem, IL Plant, Salem, Illinois including on-
site leased workers from Westaff, Manpower, and Select (TA-W-
64,526A); North American Lighting, Inc., Flora, IL Plant,
Flora, Illinois including on-site leased workers from Westaff
(TA-W-64,526B); and North American Lighting, Inc., Corporate
Headquarters, Paris, Illinois (TA-W-64,526C) who became
totally or partially separated from employment, on or after
November 21, 2007 through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
