Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on November 3, 2008,
applicable to workers of Hickory Hardware, Administration
Division, Nashville, Tennessee. The notice will be published
soon in the Federal Register.
At the request of a company official, the Department
reviewed the certification for workers of the subject firm. The
workers provide administrative support for the production of
casters at the subject firm.
New information shows that workers leased from Aerotek were
employed on-site at the Nashville, Tennessee location of Hickory
Hardware, Administration Division. The Department has determined
that these workers were sufficiently under the control of Hickory
Hardware, Administration Division to be considered leased
workers.
Based on these findings, the Department is amending this
certification to include workers leased from Aerotek working on-
site at the Nashville, Tennessee location of the subject firm.
The intent of the Department’s certification is to include
all workers employed at Hickory Hardware, Administration
Division, Nashville, Tennessee who were adversely affected by
increased imports of casters.
The amended notice applicable to TA-W-64,096B is hereby
issued as follows:
"All workers of Hickory Hardware, Administration
Division, including on-site leased workers from
Aerotek, Nashville, Tennessee, who became totally or
partially separated from employment on or after
September 22, 2007, through November 3, 2010, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on September 23, 2008, in
response to a petition filed by a company official on behalf of
workers of three Divisions of Hickory Hardware: Hickory Hardware,
Caster Assembly Division, Nashville, Tennessee (TA-W-64,096);
Hickory Hardware, Inventory Support Division, Nashville, Tennessee
(TA-W-64,096A); and Hickory Hardware, Administration Division,
Nashville, Tennessee (TA-W-64,096B). Workers of the Caster
Assembly Division produce assembled casters. Workers of the
Inventory Support Division ship and receive the casters assembled
in Nashville as well as imported casters and hardware. Workers of
the Administration Division support all functions related to both
casters assembled in Nashville and imported casters and hardware.
The investigation revealed that employment at the subject firm
decreased through August 2008, and further separations are
anticipated in 2008, as the subject firm plans to cease production.
The investigation also revealed that the subject firm had an
increased reliance on imports from China of products like or
directly competitive with casters assembled in Nashville.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of
eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or
over and possess skills that are not easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with casters produced at Hickory
Hardware, Nashville, Tennessee contributed importantly to the total
or partial separation of workers and to the decline in sales or
production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:


"All workers of Hickory Hardware, Caster Assembly Division,
Nashville, Tennessee (TA-W-64,096) including leased workers of
Accountemps, Adeccon Ind., Kelly Services, Progistix &
Ranstad; Hickory Hardware, Inventory Support Division,
Nashville, Tennessee (TA-W-64,096A) including leased workers
of Accountemps, Adeccon Ind., Kelly Services, Progistix &
Ranstad; and Hickory Hardware, Administration Division,
Nashville, Tennessee (TA-W-64,096B) who became totally or
partially separated from employment on or after September 22,
2007, through two years from the date of certification are
eligible to apply for adjustment assistance under Section 223
of the Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974.”
