Amended Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on September 19, 2008,
applicable to workers of Hewlett Packard, Inkjet and Web
Solutions Division, including on-site leased workers from CDI,
Manpower, Securitas Security Services USA and Volt, Corvallis,
Oregon. The notice was published in the Federal Register on
October 3, 2008 (73 FR 57682). The certification was amended on
December 4, 2008 to include on-site leased workers from Cable
Consultants, d/b/a Black Box Network Services. The notice was
published in the Federal Register on December 15, 2008 (73 FR
76058).
At the request of petitioners, the Department reviewed the
certification for workers of the subject firm. The workers are
engaged in the production of inkjet supplies, particularly in jet
printer cartridge heads.
New information shows that workers leased from Managed
Business Solutions and 888 Consulting Group, Inc., d/b/a TAC
Worldwide were employed on-site at the Corvallis, Oregon location
of Hewlett Packard, Inkjet and Web Solutions Division. The
Department has determined that these workers were sufficiently
under the control of the subject firm to be considered leased
workers.
Based on these findings, the Department is amending this
certification to include leased workers from Managed Business
Solutions and 888 Consulting Group, Inc., d/b/a TAC Worldwide
working on-site at the Inkjet and Web Solutions Division,
Corvallis, Oregon location of the subject firm.


The amended notice applicable to TA-W-63,939 is hereby
issued as follows:
"All workers of Hewlett Packard, Inkjet and Web
Solutions Division, including on-site leased workers
from CDI, Manpower, Securitas Security Services USA,
Volt, Managed Business Solutions and 888 Consulting
Group, Inc., d/b/a TAC Worldwide, Corvallis, Oregon,
engaged in the production of inkjet supplies, who
became totally or partially separated from employment
on or after August 26, 2007, through September 19,
2010, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on August 27, 2008 in response
to a petition filed on behalf of workers of Hewlett Packard, Inkjet
and Web Solutions Division, Corvallis, Oregon. The workers produce
inkjet supplies, particularly ink jet printer cartridge heads.
The petition was filed specifically for workers in the
Technology Development Organization located within the subject
facility. The investigation determined that all worker groups are
within the Inkjet and Web Solutions Division and are engaged in
activities related to production of inkjet supplies. Accordingly,
the investigation was expanded to include all workers in the Inkjet
and Web Solutions Division of Hewlett Packard in Corvalis, Oregon.
The investigation revealed that the worker group at Hewlett
Packard Inkjet and Web Solutions Division also employed on-site
leased workers from CDI, Manpower, Securitas Security Services USA
and Volt.
The investigation also revealed that the preponderance of
declines in employment at the subject facility is related to a
shift in production of inkjet supplies to a country (Singapore)
that is party to a free trade agreement with the United States.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that was a shift in production from the
workers’ firm or subdivision to Singapore of articles like or
directly competitive with inkjet supplies produced by Hewlett
Packard, Inkjet and Web Solutions Division, Corvallis, Oregon. In
accordance with the provisions of the Act, I make the following
certification:
"Workers of Hewlett Packard, Inkjet and Web Solutions
Division, Corvallis, Oregon, including on-site leased workers
from CDI, Manpower, Securitas Security Services USA and Volt,
engaged in the production of inkjet supplies, who become
totally or partially separated from employment on or after
August 26, 2007, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
