Amended Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on June 5, 2008,
applicable to workers of General Motors Corporation, Moraine
Assembly Plant, Vehicle Manufacturing Division, Moraine, Ohio.
The notice was published in the Federal Register on June 20, 2008
(73 FR 35164). The certification was amended on December 4, 2008
to include on-site leased workers from Allied Systems, Ltd. The
notice was published in the Federal Register on December 15, 2008
(73 FR 76057-76058)
At the request of a petitioner, the Department reviewed the
certification for workers of the subject firm. The workers
assemble Buick Rainiers, Chevrolet TrailBlazers, GMC Envys, Isuzu
Ascenders and Saab 9-7Xs.
New information shows that workers leased from Securitas
were employed on-site at the Moraine, Ohio location of General
Motors Corporation, Moraine Assembly Plant, Vehicle Manufacturing
Division. The Department has determined that these workers were
sufficiently under the control of the subject firm to be
considered leased workers.
Based on these findings, the Department is amending this
certification to include leased workers from Securitas working
on-site at the Moraine Assembly Plant, Vehicle Manufacturing
Division, Moraine, Ohio location of the subject firm.


The amended notice applicable to TA-W-63,344 is hereby
issued as follows:
"All workers of General Motors Corporation, Moraine
Assembly Plant, Vehicle Manufacturing Division,
including on-site leased workers from Allied Systems,
LTD, and Securitas, Moraine, Ohio, who became totally
or partially separated from employment on or after June
17, 2008, through June 5, 2010, are eligible to apply
for adjustment assistance under Section 223 of the
Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on May 8, 2008, in response to
a petition filed on behalf of workers of General Motors
Corporation, Moraine Assembly Plant, Vehicle Manufacturing
Division, Moraine, Ohio. The workers assemble Buick Rainiers,
Chevrolet TrailBlazers, GMC Envoys, Isuzu Ascenders and Saab 9-7Xs.
Workers are not separately identifiable by specific vehicle.
The workers of the firm were certified eligible to apply for
adjustment assistance under TA-W-59,218, which expires June 16,
2008.
The investigation revealed that employment and sales declined
in 2007 compared with 2006, and also declined in January through
April 2008 compared with the same period in 2007. Further
separations are threatened.
The Department of Labor conducted an analysis of the United
States market share of vehicles like or directly competitive with
the vehicles produced at the Moraine Assembly Plant. Chevrolet
TrailBlazer and Isuzu Ascender are upper mid-range sport-utility
vehicles; Buick Rainier, GMC Envoy and Saab 9-7X are lower mid-
range sport-utility vehicles. The investigation determined that
imports of such vehicles increased their share of the U.S. market
from 2006 to 2007 and in January through April 2008 compared with
the same period in 2007, while the subject vehicles decreased their
share of the U.S. market. Sales of other domestically manufactured
vehicles in the same category declined as well.
Although aggregate U.S. sales of imported like or directly
competitive vehicles declined in 2007 and the partial year 2008
period, sales of like vehicles produced at the subject firm
experienced much greater declines, showing an increased consumer
reliance on vehicles produced abroad.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
Conclusion
After careful review of the facts obtained in the investigation,
I determine that increases of imports of articles like or directly
competitive with the vehicles produced at the subject plant
contributed importantly to the total or partial separation of workers
and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make the
following certification:


"All workers of General Motors Corporation, Moraine Assembly
Plant, Vehicle Manufacturing Division, Moraine, Ohio, who
become totally or partially separated from employment on or
after June 17, 2008 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
