Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273) the Department Labor issued a Certification of
Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on April 3, 2008,
applicable to workers of Panasonic Sikoku Electronics Corporation
of America (PSECA), including on-site leased workers of Express
Personnel Services, Vancouver, Washington. The notice was
published in the Federal Register on April 17, 2008 (73 FR
20954).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
are engaged in the production of MMD/rear projection televisions.
New findings show that worker separations occurred at the
Portland, Oregon facility of Panasonic Shikoku Electronics Sales
of America, LLC. Workers at the Portland, Oregon facility
provide purchasing and sales activities supporting the production
of MMD/rear projection televisions that is produced at the
Vancouver, Washington location of the subject firm
Accordingly, the Department is amending the certification to
cover workers at Panasonic Shikoku Electronics Sales of America,
LLC, Portland, Oregon.
The intent of the Department's certification is to include
all workers of Panasonic Shikoku Electronics Corporation of
America (PSECA) who were adversely affected by increased imports.


The amended notice applicable to TA-W-62,835 is hereby
issued as follows:
"All workers of Panasonic Shikoku Electronics Corporation of
America (PSECA), including on-site leased workers of Express
Personnel Services, Vancouver, Washington (TA-W-62,835), and
Panasonic Shikoku Electronics Sales of America, LLC,
Portland, Oregon (TA-W-62,835A), who became totally or
partially separated from employment on or after March 22,
2008, through April 3, 2010, are eligible to apply for
adjustment assistance under Section 223 of the Trade Act of
1974, and are also eligible to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on February 12, 2008, in
response to a petition filed by a company official on behalf of
workers at Panasonic Shikoku Electronics Corporation of America
(PSECA), Vancouver, Washington. The worker group also includes
leased workers of Express Personnel Services working on site at
Panasonic Shikoku Electronics Corporation of America (PSECA),
Vancouver, Washington. The workers of the subject firm produce
MMD/rear projection televisions.
Workers at the subject facility were covered by an existing
certification (TA-W-58,807), that expired on March 21, 2008.
The investigation revealed that sales, production and
employment declined at the subject facility during the relevant
period.
The Department of Labor conducted a survey of the subject
firm’s major declining customers regarding purchases of MMD/rear
projection televisions and like or directly competitive televisions
during 2006, 2007, January 2008 over the corresponding 2007 period.
The survey revealed an increased reliance on imported televisions
during the relevant period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.

Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with MMD/rear projection televisions
produced at Panasonic Shikoku Electronics Corporation of America
(PSECA), Vancouver, Washington, contributed importantly to the
total or partial separation of workers and to the decline in sales
or production at that firm or subdivision.



In accordance with the provisions of the Act, I make the
following certification:
"All workers of Panasonic Shikoku Electronics Corporation of
America (PSECA), Vancouver, Washington, including on-site
leased workers of Express Personnel Services, who became
totally or partially separated from employment on or after
March 22, 2008, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
