Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either
paragraph (a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act
must be met.
The investigation was initiated on January 24, 2008 in
response to a petition filed by a state agency representative on
behalf of workers of the Bartech Group, working on-site at two
divisions of Delphi Corporation: Powertrain Division (TA-W-
62,730), and the Electronics and Safety Division (TA-W-62,730A),
all located within the same facility in Oak Creek, Wisconsin.
The workers of the Powertrain Division produce catalytic
converters and the workers of the Electronics and Safety
Division produce electronic engine controllers and body
controllers. All products are used in the automotive industry.
The workers are separately identifiable by division.
With respect to workers of the Bartech Group, working on-
site at Delphi Corporation, Powertrain Division, Oak Creek,
Wisconsin, it is determined that the requirements of (a)(2)(B)
are met.
All workers of Delphi Corporation, Powertrain Division, Oak
Creek, Wisconsin were certified eligible to apply for trade
adjustment assistance under petition number TA-W-62,296 on
October 17, 2007.
The investigation revealed that the decline in employment
of the Bartech Group, working on-site at Delphi Corporation,
Powertrain Division, Oak Creek, Wisconsin, was the result of a
shift in production of catalytic converters to Mexico, a country
which is party to a free trade agreement with the United States.
With respect to workers of the Bartech Group, working on-
site at Delphi Corporation, Electronics and Safety Division, Oak
Creek, Wisconsin, it is determined that the requirements of
(a)(2)(A) are met.
All workers of Delphi Corporation, Electronics and Safety
Division, Oak Creek, Wisconsin were certified eligible to apply
for trade adjustment assistance under petition number TA-W-
62,297 on November 27, 2007.
The investigation revealed that the decline in employment
of the Bartech Group, working on-site at Delphi Corporation,
Electronics and Safety Division, Oak Creek, Wisconsin, was the
result of increased customer imports of electronic engine
controllers and body controllers.
In accordance with Section 246 the Trade Act of 1974 (26
USC 2813), as amended, the Department of Labor herein presents
the results of its investigation regarding certification of
eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
Since the workers of Delphi Corporation, Powertrain
Division, and Electronics and Safety Division, Oak Creek,
Wisconsin are certified eligible to apply for alternative trade
adjustment assistance (ATAA), the Department is extending that
eligibility to the employees of the Bartech Group, working on-
site at two divisions of Delphi Corporation: Powertrain Division
(TA-W-62,730), and the Electronics and Safety Division (TA-W-
62,730A), Oak Creek, Wisconsin.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers' firm or subdivision to Mexico of articles that
are like or directly competitive with catalytic converters
produced by Delphi Corporation, Powertrain Division, Oak Creek,
Wisconsin, and that increases of imports of articles like or
directly competitive with electronic engine controllers and body
controllers produced by Delphi Corporation, Electronics and
Safety Division, Oak Creek, Wisconsin, contributed importantly
to the total or partial separation of workers and to the decline
in sales or production at that firm or subdivision. In
accordance with the provisions of the Act, I make the following
certification:


"All workers of the Bartech Group, working on-site at
Delphi Corporation, Powertrain Division, Oak Creek,
Wisconsin (TA-W-62,730), and all workers of the Bartech
Group, working on-site at Delphi Corporation, Electronics
and Safety Division, Oak Creek, Wisconsin, who became
totally or partially separated from employment on or after
January 18, 2007 through two years from the date of
certification are eligible to apply for adjustment assis-
tance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."
