Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on January 10, 2008,
applicable to workers of Halmode Apparel, a Division of Kellwood
Company, New York, New York. The notice was published in the
Federal Register on January 25, 2008 (73 FR 4634).
At the request of a company official, the Department reviewed
the certification for workers of the subject firm. The workers are
engaged in activities related to the production women’s apparel
samples and patterns.
New information provided by the company official shows that
some of workers wages at Halmode Apparel are reported under
Federal Employment Identification Number (FEIN) for Halmode
Apparel/Liz Claiborne Dresses.
Accordingly, the Department is amending the certification to
include workers of Halmode Apparel, a Division of Kellwood
Company, 1400 Broadway, New York, New York, whose wages were
reported under the FEIN for Halmode/Liz Claiborne Dresses.
The amended notice applicable to TA-W-62,484 is hereby
issued as follows:
"All workers of Halmode Apparel, Halmode/Liz Claiborne
Dresses, 1400 Broadway, a Division of Kellwood Company, New
York, New York, who became totally or partially separated from
employment on or after November 4, 2007, through January 10,
2010, are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also eligible to
apply for alternative trade adjustment assistance under
Section 246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on November 20, 2007 in
response to a petition filed by the New York Metropolitan Area
Joint Board, Local 155 (UNITE HERE) on behalf of workers of Halmode
Apparel, A Division of Kellwood Company, New York, New York. The
workers manufacture women’s apparel samples and patterns.
The worker group was certified eligible to apply for
adjustment assistance under petition number TA-W-58,138, which
expired on November 3, 2007.
This investigation revealed that employment at the subject
firm continued to decline after the expiration of the certification
described above.
Production at the subject firm declined during January through
October 2007, when compared to the same time period in 2006.
The investigation further revealed that the subject firm
increased imports of samples and patterns during the relevant
period.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and possess skills that are not easily transferable. Competitive
conditions within the industry are adverse.






Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with women’s apparel samples and
patterns produced by Halmode Apparel, A Division of Kellwood
Company, New York, New York, contributed importantly to the total
or partial separation of workers and to the decline in sales or
production at that firm or subdivision.


In accordance with the provisions of the Act, I make the
following certification:
"All workers of Halmode Apparel, A Division of Kellwood
Company, New York, New York, who became totally or partially
separated from employment on or after November 4, 2007,
through two years from the date of certification are eligible
to apply for adjustment assistance under Section 223 of the
Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section 246 of
the Trade Act of 1974."
