Negative Determination Regarding Eligibility
To Apply For Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance



In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents
the results of an investigation regarding certification of
eligibility to apply for worker adjustment assistance.
The investigation was initiated on November 15, 2007 in
response to a petition filed by a company official on behalf of
workers of forty-five locations of Springs Global, US, Inc:
namely, the Springs Direct Division, Corporate Support Group,
Lancaster, South Carolina (TA-W-62,469), and forty-four
Springmaid Wamsutta Factory Store Division locations throughout
the United States (TA-W-62,469A through TA-W-62,469RR). Workers
of the Springs Direct Division, Corporate Support Group are
engaged in administration, human resources, inventory,
logistics, merchandizing, operations, and accounting services.
Workers of the Springmaid Wamsutta Factory Stores are engaged in
receiving products, inventory, merchandizing, marketing,
ordering, and sales services at factory outlet stores. All
subject workers are separately identifiable by location.
In order to be considered eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, the
worker group seeking certification (or on whose behalf
certification is being sought) must work for a "firm" or
appropriate subdivision that produces an article domestically
and there must be a relationship between the workers' work and
the article produced by the workers' firm or appropriate
subdivision. The investigation revealed that although
production of an article occurred within the firm or appropriate
subdivision, the Springs Direct Division, Corporate Support
Group workers and Springmaid Wamsutta Factory Store workers do
not support this production. Thus the worker group cannot be
considered import impacted or affected by a shift in production
of an article.
The subject workers of both the Springs Direct Division,
Corporate Support Group and Springmaid Wamsutta Factory Stores
are engaged in retail services or the administration of these
services. They sell articles produced by Springs Global, US,
Inc, but are not associated with the production of these
articles.
In addition, in accordance with Section 246 the Trade Act
of 1974 (26 USC 2813), as amended, the Department of Labor
herein presents the results of its investigation regarding
certification of eligibility to apply for alternative trade
adjustment assistance (ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the worker group must be
certified eligible to apply for trade adjustment assistance
(TAA). Since the workers are denied eligibility to apply for
TAA, the workers cannot be certified eligible for ATAA.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that all workers of Springs Global,
US, Inc, Springs Direct Division, Corporate Support Group,
Lancaster, South Carolina (TA-W-62,469), and all workers of
Springs Global, US, Inc, Springmaid Wamsutta Factory Store
Division located in Albertville, Minnesota (TA-W-62,469A),
Asheville, North Carolina (TA-W-62,469B), Batesville,
Mississippi (TA-W-62,469C), Bend, Oregon (TA-W-62,469D), Birch
Run, Michigan (TA-W-62,469E), Boise, Idaho (TA-W-62,469F),
Branson, Missouri (TA-W-62,469G), Burbank, Ohio (TA-W-62,469H),
Calhoun, Georgia (TA-W-62,469I), Castle Rock, Colorado (TA-W-
62,469J), Commerce, Georgia (TA-W-62,469K), Conroe, Texas (TA-W-
62,469L), Darien, Georgia (TA-W-62,469M), Ellenton, Florida (TA-
W-62,469N), Gaffney, South Carolina (TA-W-62,469O), Gainsville,

(TA-W-62,469RR), are denied eligibility to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also denied eligibility to apply for alternative trade
adjustment assistance under Section 246 of the Trade Act of
1974.
