Amended Certification Regarding Eligibility
to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on November 8, 2007,
applicable to workers of Ford Motor Company, Louisville Assembly
Plant, Vehicle Operation Division, Louisville, Kentucky. The
notice was published in the Federal Register on November 21, 2007
(72 FR 65607).
At the request of the petitioner, the Department reviewed
the certification for workers of the subject firm. The workers
assemble Ford Explorers, Ford Explorer Sport Tracs and Mercury
Mountaineers.

New information shows that leased workers from Comprehensive
Logistics, Inc. and Source Providers, Inc. were employed on-site
at the Louisville, Kentucky location of Ford Motor Company,
Louisville Assembly Plant, Vehicle Operation Division. The
Department has determined that these workers were sufficiently
under the control of the subject firm to be considered leased
workers.
Based on these findings, the Department is amending this
certification to include leased workers from Comprehensive
Logistics, Inc. and Source Providers, Inc. working on-site at the
Louisville, Kentucky location of the subject firm.
The intent of the Department’s certification is to include
all workers employed at Ford Motor Company, Louisville Assembly
Plant, Vehicle Operation Division who were adversely affected by
increased imports of Ford Explorers, Ford Explorer Sport Tracs
and Mercury Mountaineers.

The amended notice applicable to TA-W-62,214 is hereby
issued as follows:
"All workers of Ford Motor Company, Louisville Assembly
Plant, Vehicle Operation Division, including on-site
leased workers from Comprehensive Logistics, Inc. and
Source Providers, Inc., Louisville, Kentucky, who
became totally or partially separated from employment
on or after September 24, 2006, through November 8,
2009, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”
Signed at Washington, D.C., this 31st day of July 2008

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance
and Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on September 27, 2007, in
response to a petition filed by a UAW, Local 862 official on behalf
of workers of Ford Motor Company, Louisville Assembly Plant,
Vehicle Operation Division, Louisville, Kentucky. The workers
assemble Ford Explorers, Ford Explorer Sport Tracs and Mercury
Mountaineers. Workers are not separately identifiable by specific
vehicle.
The investigation revealed that employment and sales to final
customers declined in 2006 compared with 2005 and in January
through August 2007 compared with the same period in 2006.
The Department of Labor conducted an analysis of the United
States market share of vehicles like or directly competitive with
the vehicles produced at the Louisville Assembly Plant. The
investigation determined that imports of such vehicles increased
their share of the U.S. market from 2005 to 2006 and in January
through August 2007 compared with the same period in 2006, while
Ford produced Explorers, Explorer Sport Tracs and Mountaineers
decreased their share of the U.S. market during the same
comparative periods. Sales to final customers of other domestically
manufactured vehicles declined as well.
Although aggregate U.S. sales of imported like or directly
competitive vehicles declined slightly in 2006 and the partial year
2007 period, sales to final customers of like vehicles produced at
the subject firm experienced much greater declines, showing an
increased consumer reliance on vehicles produced abroad.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of eligibility
to apply for ATAA, the group eligibility requirements of Section
246 of the Trade Act must be met. The Department has determined in
this case that the requirements of Section 246 have been met.
Conclusion
After careful review of the facts obtained in the investigation,
I determine that increases of imports of articles like or directly
competitive with the vehicles produced at the subject plant
contributed importantly to the total or partial separation of workers
and to the decline in sales or production at that firm or
subdivision. In accordance with the provisions of the Act, I make the
following certification:

"All workers of Ford Motor Company, Louisville Assembly Plant,
Vehicle Operation Division, Louisville, Kentucky, who became
totally or partially separated from employment on or after
September 24, 2006 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
Signed in Washington, D.C., this 8th day of November 2007
