Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on September 13, 2007,
applicable to workers of Hanesbrands, Inc., Eden, North Carolina
and Hanesbrands, Inc., Forest City Division, Forest City, North
Carolina. The notice was published in the Federal Register on
September 27, 2007 (72 FR 54939).
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of laminated fabric and fabric
components.
New information shows that Hanesbrands, Inc. purchased
National Textiles, LLC in June 2006. Workers separated from
employment at the Eden Division, Eden, North Carolina and the
Forest City Division, Forest City, North Carolina locations of
the subject firm had their wages reported under separate
unemployment insurance (UI) tax account for National Textiles,
LLC.
Findings also show that there was a previous certification,
TA-W-55,365, issued on September 13, 2006, for the workers of the
Forest City Division, Forest City, North Carolina. That
certification expired September 13, 2006. To avoid an overlap in
worker group coverage for workers of the Forest City, North
Carolina location, the certification is being amended to change
the impact date from August 7, 2006 to September 14, 2006.
Accordingly, the Department is amending the certification to
properly reflect these matters.
The intent of the Department’s certification is to include
all workers of Hanesbrands, Inc. who were adversely affected by a
shift in production of laminated fabric and fabric components to
El Salvador, the Dominican Republic and Honduras.
The amended notice applicable to TA-W-61,962K and TA-W-
61,962L are hereby issued as follows:


"All workers of Hanesbrands, Inc., National Textiles,
LLC, Eden Division, Eden, North Carolina (TA-W-
61,962K), who became totally or partially separated
from employment on or after August 7, 2006 through
September 13, 2009, are eligible to apply for
adjustment assistance under Section 223 of the Trade
Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974."
and
“All workers of Hanesbrands, Inc., National Textiles,
LLC, Forest City Division, Forest City, North Carolina
(TA-W-61,962L), who became totally or partially
separated from employment on or after September 14,
2006, through September 13, 2009, are eligible to apply
for adjustment assistance under Section 223 of the
Trade Act of 1974, and are also eligible to apply for
alternative trade adjustment assistance under Section
246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on August 9, 2007 in response
to a petition filed by a company official on behalf of workers of
thirteen divisions of Hanesbrands, Inc.: Meacham Road Division,
Statesville, North Carolina (TA-W-61,962), Oak Summit Division,
Winston-Salem, North Carolina (TA-W-61,962A), ECD Division,
Winston-Salem, North Carolina (TA-W-61,962B), Tamaqua Division,
Tamaqua, Pennsylvania (TA-W-61,962C), Weeks Center Division,
Winston-Salem, North Carolina (TA-W-61,962D), Woolwine Division,
Stuart, Virginia (TA-W-61,962E), Northridge Division, Rural Hall,
North Carolina (TA-W-61,962F), Laurel Hill Division, Laurel Hill,
North Carolina (TA-W-61,962G), Kings Mountain Division, Kings
Mountain, North Carolina (TA-W-61,962H), VSC Division,
Martinsville, Virginia (TA-W-61,962I), NYC-Design Division, New
York, New York (TA-W-61,962J), Eden Division, Eden, North Carolina
(TA-W-61,962K), and Forest City Division, Forest City, North
Carolina (TA-W-61,962L). The workers at the Meacham Division
produce laminated fabric and fabric components and are not
separately identifiable by article. The workers at all other
divisions support production at the Meacham Division with a variety
of services, including administration, inventory, finance, customer
service, and design. The workers are separately identifiable by
location.
Workers of the Oak Summit Division (TA-W-61,962A) were
certified eligible for Trade Adjustment Assistance (TAA) under
petition TA-W-57,802 which expires on September 28, 2007.
The investigation revealed that employment at all divisions
either declined in January through July 2007 or a significant
number or proportion of workers are threatened to become separated
from employment.
The subject firm has shifted a portion of production of
laminated fabric and fabric components to several countries (El
Salvador, the Dominican Republic, and Honduras) which are
beneficiary countries under the Caribbean Basin Economic Recovery
Act.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the facility are age 50 or
over and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.


Conclusion
After careful review of the facts obtained in the
investigation, I determine that there was a shift in production
from the workers’ firm or subdivision to El Salvador, the Dominican
Republic, and Honduras of articles that are like or directly
competitive with those produced by the subject firm or subdivision.
In accordance with the provisions of the Act, I make the following
certification:


"All workers of Hanesbrands, Inc., Meacham Road Division,
Statesville, North Carolina (TA-W-61,962), ECD Division,
Winston-Salem, North Carolina (TA-W-61,962B), Tamaqua
Division, Tamaqua, Pennsylvania (TA-W-61,962C), Weeks Center
Division, Winston-Salem, North Carolina (TA-W-61,962D),
Woolwine Division, Stuart, Virginia (TA-W-61,962E), Northridge
Division, Rural Hall, North Carolina (TA-W-61,962F), Laurel
Hill Division, Laurel Hill, North Carolina (TA-W-61,962G),
Kings Mountain Division, Kings Mountain, North Carolina (TA-W-
61,962H), VSC Division, Martinsville, Virginia (TA-W-61,962I),
NYC-Design Division, New York, New York (TA-W-61,962J), Eden
Division, Eden, North Carolina (TA-W-61,962K), and Forest City
Division, Forest City, North Carolina (TA-W-61,962L), who
became totally or partially separated from employment on or
after August 7, 2006, through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974;” and


“All workers of Hanesbrands, Inc., Oak Summit Division,
Winston-Salem, North Carolina (TA-W-61,962A), who became
totally or partially separated from employment on or after
September 29, 2007 through two years from the date of
certification are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974;”
