Amended Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on September 13, 2007,
applicable to workers of Micron Technology, Inc., Research and
Development and Manufacturing, Boise, Idaho. The notice was
published in the Federal Register on September 27, 2007 (72 FR
54939).
New information shows that workers leased workers from
Bledsoe Construction, Inc. were employed on-site at the Boise,
Idaho location of Micron Technology, Inc., Research and
Development and Manufacturing, Boise, Idaho. The Department has
determined that these workers were sufficiently under the control
of Micron Technology, Inc., Research and Development and
Manufacturing, Boise, Idaho to be considered leased workers.
Based on these findings, the Department is amending this
certification to include workers leased from Bledsoe
Construction, Inc. working on-site at the Boise, Idaho location
of the subject firm.
The intent of the Department’s certification is to include
all workers employed at Micron Technology, Inc., Research and
Development and Manufacturing, Boise, Idaho who were adversely
affected by increased imports of memory chips.


The amended notice applicable to TA-W-61,811 is hereby
issued as follows:
" All workers of Micron Technology, Inc., Research and
Development and Manufacturing, Boise, Idaho, including
on-site leased workers of Kelly Services, SOS,
Manpower, Volt, Vot Technical, Fujitsu, Aerotek, Tek
Systems and Bledsoe Construction, Inc., who became
totally or partially separated from employment on or
after July 9, 2006, through September 13, 2009, are
eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974 and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974, as
amended (19 USC 2273), the Department of Labor herein presents the
results of an investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(B) of
Section 222 have been met.
The investigation was initiated on July 10, 2007, in response
to a petition filed by a company official on behalf of workers of
Micron Technology, Inc., Research and Development and
Manufacturing, Boise, Idaho (TA-W-61,811), Micron Technology, Inc.,
Micron West-Warehouse, Nampa, Idaho (TA-W-61,811A), Micron
Technology, Inc., Fab 1D Manufacturing, Nampa, Idaho (TA-W-
61,811B), Micron Technology, Inc., Design Center and Design Center
and Sales 3080/3060, San Jose, California (TA-W-61,811C), Micron
Technology, Inc., Design Center, Pasadena, California (TA-W-
61,811D), Micron Technology, Inc., Design Center, Minneapolis,
Minnesota (TA-W-61,811E), Micron Technology, Inc., Research and
Design Center, Corvallis, Oregon (TA-W-61,811F), Micron Technology,
Inc., Research and Design Center, Fort Collins, Colorado (TA-W-
61,811G), Micron Texas Engineering Center, LLC, Design Center,
Allen, Texas (TA-W-61,811H), Micron Semiconductor Product, Finished

workers at the subject facilities are engaged in the production or
in support of the production of memory chips (i.e. Dynamic Access
Memory (DRAM), NAND Memory and CMOS Image Sensors).
The decline in employment at the Micron Technology Inc.,
locations, including its subsidiaries Micron Engineering Center,
LLC, Micron Semiconductor Products, and Lexar Media, all cited
above, is related to a shift in production of the memory chips
(i.e. Dynamic Access Memory (DRAM), NAND Memory and CMOS Image
Sensors) to a country (Singapore) that is party to a free trade
agreement with the United States.
Micron Technology, Inc., Boise, Idaho (TA-W-61,811), also
leased on-site workers from also leased workers from Kelly
Services, SOS, Manpower, Volt, Vot Technical, Fujitsu, Aerotek, and
Tek Systems.
Micron Technology, Inc., Design Center and Design Center and
Sales 3080/3060, San Jose, California (TA-W-61,811C), also leased
workers from Kelly Services, Coast Personnel Services and West
Valley Staffing Group.
Micron Technology, Inc., Research and Design Center,
Corvallis, Oregon (TA-W-61,811G), also leased workers from Volt
Technical.
In accordance with Section 246 the Trade Act of 1974 (26 USC
2813), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for alternative trade adjustment assistance (ATAA) for
older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
A significant number of workers at the firm are age 50 or over
and do not possess skills that are easily transferable.
Competitive conditions within the industry are adverse.
Conclusion
After careful review of the facts obtained in the
investigation, I conclude that there was a shift in production from
the workers' firm or subdivision to Singapore of articles that are
like or directly competitive with the memory chips (i.e. Dynamic
Access Memory (DRAM), NAND Memory and CMOS Image Sensors) produced
by the subject firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
“All workers of Micron Technology, Inc., Research and
Development and Manufacturing, Boise, Idaho, including on-site
leased workers of Kelly Services, SOS, Manpower, Volt, Vot
Technical, Fujitsu, Aerotek and Tek Systems (TA-W-61,811),
Micron Technology, Inc., Micron West-Warehouse, Nampa, Idaho
(TA-W-61,811A), Micron Technology, Inc., Fab 1D Manufacturing,
Nampa, Idaho (TA-W-61,811B), Micron Technology, Inc., Design
Center and Design Center and Sales 3080/3060, including on-
site leased workers of Kelly Services, Coast Personnel
Services and West Valley Staffing Group, San Jose, California
(TA-W-61,811C), Micron Technology, Inc., Design Center,
Pasadena, California (TA-W-61,811D), Micron Technology, Inc.,
Design Center, Minneapolis, Minnesota (TA-W-61,811E), Micron
Technology, Inc., Research and Design Center, including on-
site leased workers of Volt Technical, Corvallis, Oregon (TA-
W-61,811F), Micron Technology, Inc., Research and Design
Center, Fort Collins, Colorado (TA-W-61,811G), Micron Texas
Engineering Center, LLC, Design Center, Allen, Texas (TA-W-
61,811H), Micron Semiconductor Product, Finished Goods
Manufacturing and Crucial Sales Office, Meridian, Idaho (TA-W-
61,811I), Lexar Media, Freemont, California (TA-W-61,811J),
who became totally or partially separated from employment on
or after July 9, 2006, through two years from the date of
certification, are eligible to apply for adjustment assistance
under Section 223 of the Trade Act of 1974 and are also
eligible to apply for alternative trade adjustment assistance
under Section 246 of the Trade Act of 1974.”
