Amended Certification Regarding Eligibility to
Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), and Section 246 of the Trade Act of 1074 (26 USC
2813), as amended, the Department of Labor issued a Certification
of Eligibility to Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance on August 13, 2007,
applicable to workers of LINQ Industrial Fabrics, Inc.,
Summerville, South Carolina. The notice will be published soon
in the Federal Register.
At the request of the State agency, the Department reviewed
the certification for workers of the subject firm. The workers
were engaged in the production of woven and non woven industrial
textile fabrics.
New information shows that when LINQ Industrial Fabrics,
Inc., closed April 30, 2007, Thrace-LINQ, Inc. and Texene LLC
purchased the assets of the subject firm. Workers of the subject
firm then became employees of Thrace-LINQ, Inc. and Texene LLC,
and their wages were reported under two separate unemployment
insurance (UI) tax accounts: Thrace-LING, Inc. and Texene LLC.
Accordingly, the Department is amending the certification to
properly reflect this matter.
The intent of the Department’s certification is to include
all workers of LINQ Industrial Fabrics, Inc. who were adversely
affected by increased customer imports.
The amended notice applicable to TA-W-61,550 is hereby
issued as follows:
"All workers of LINQ Industrial Fabrics, Inc.,
including workers whose wages were paid by Thrace-LINQ,
Inc. and Texene LLC, Summerville, South Carolina, who
became totally or partially separated from employment
on or after April 30, 2006, through August 13, 2009,
are eligible to apply for adjustment assistance under
Section 223 of the Trade Act of 1974, and are also
eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974."

Certification Regarding Eligibility
To Apply for Worker Adjustment Assistance and
Alternative Trade Adjustment Assistance

In accordance with Section 223 of the Trade Act of 1974 (19
USC 2273), as amended, the Department of Labor herein presents the
results of its investigation regarding certification of eligibility
to apply for worker adjustment assistance.
In order to make an affirmative determination and issue a
certification of eligibility to apply for Trade Adjustment
Assistance, the group eligibility requirements in either paragraph
(a)(2)(A) or (a)(2)(B) of Section 222 of the Trade Act must be met.
It is determined in this case that the requirements of (a)(2)(A) of
Section 222 have been met.
The investigation was initiated on May 21, 2007 in response to
a petition filed by a company official on behalf of workers of
Walter Dimension, Jamestown, Tennessee. Workers produced woven and
non woven industrial textile fabrics.
The investigation revealed that sales, production and
employment all declined absolutely with the closure of the facility
on April 30, 2007.
The Department of Labor surveyed the subject firm’s primary
customers regarding their purchases of various types of woven and
non-woven industrial textile fabrics in 2006, and January through
May, 2007. The survey revealed increasing customer reliance on
imports during the relevant period.
In addition, in accordance with Section 246 the Trade Act of
1974 (26 USC 2813), as amended, the Department of Labor herein
presents the results of its investigation regarding certification
of eligibility to apply for alternative trade adjustment assistance
(ATAA) for older workers.
In order for the Department to issue a certification of
eligibility to apply for ATAA, the group eligibility requirements
of Section 246 of the Trade Act must be met. The Department has
determined in this case that the requirements of Section 246 have
been met.
According to the company official the subject facility has a
significant number of workers who are age 50 or over who possess
skills that are not easily transferable to positions in the local
area. Conditions are adverse within the industry.
Conclusion
After careful review of the facts obtained in the
investigation, I determine that increases of imports of articles
like or directly competitive with woven and non woven industrial
textile fabrics produced at LINQ Industrial Fabrics, Inc.
Summerville, South Carolina, contributed importantly to the total
or partial separation of workers and to the decline in sales or
production at that firm or subdivision. In accordance with the
provisions of the Act, I make the following certification:
"All workers of LINQ Industrial Fabrics, Inc., Summerville,
South Carolina, who became totally or partially separated from
employment on or after April 30, 2006 through two years from
the date of certification are eligible to apply for adjustment
assistance under Section 223 of the Trade Act of 1974, and are
also eligible to apply for alternative trade adjustment
assistance under Section 246 of the Trade Act of 1974.”
